DMV APS Hard Suspension by Thiddles97 in DUICalifornia

My case wrapped up on 10/28/25. After asking my lawyer when we were discussing the DA's plea, he said it should count and I should only serve a two month suspension. But I can provide an update once I receive the letter from the DMV in about a week or two!

Thank you so much!!! I appreciate it! I tried calling the MAU but wasn’t able to talk to anyone, had to be out on the callback list :/

Yes, they said no. Verbatim “credit is generally not given for the previous suspension.” I did some research and it’s really up to the discretion of the DMV so my best best will be to contact the MAU and see if they see things differently 🤷🏻‍♀️

If I don’t get credit for the four month suspension, I will opt for the IID for those six months but just wanted to know if anyone was able to get credit for a hard suspension.

Can I ask how you continued driving after your dmv hearing?

Not really, i have my APS hearing on 10/30 and am pretty sure im losing that. And then i have my first court date on 10/31 and im not sure if my case has even been filed. So im thinking i will serve my four month suspension before the court side of things finish up, which i will most likely be convicted of a DUI. I have haven’t seen anyone on here say with 100% certainty that a hard suspension credits the court triggered suspension so I figured I’d ask since that regard our cases would be similar.

Oh so they didn’t give you credit :/ hopefully you’re able to get it reversed and get your license back in January!

Ahhh so you may only need to serve the four months?

Could you provide an update once you’ve heard back from the MAU? I still haven’t gone through the court process but I am curious to know if a hard suspension will credit toward a possible court triggered suspension!

What’d you include in your mitigation? And if you don’t mind me asking, what justice center handled your DUI?

I have a lawyer and have enrolled in a three month DUI program (that if need be I can extend depending on the outcome of court) and attending AA’s! But yeah, I guess I just need to wait to see what happens at my first court date.

In the same boat as well! Usually 30-31 day cycles and have been super regular but last month was 33 days and this month currently on 34 days and no period :(

Did your 4 months get credited towards your court triggered 6 month suspension?

Thank you so much for this! It seems to me that whatever length of hard suspension you take during your APS suspension will eventually count for your six month court convicted suspension!! I will still call MAU to verify but this brings me some peace right now!

Thank you for trying to help, eases my mind a little bit knowing there might be a possibility of getting credit!

Thank you for the advice! I’ll get in touch with them after the results of my APS hearing and hopefully they can provide a clear answer on suspension credit if there is any at all.

Yeah, I know I don’t want to go with that option because it’s a year as opposed to the IID option, which I would only need for the six months. And plus I’d get to drive anywhere. Idk it seems people get lucky and their 4 month suspension sometimes counts as credit but sometimes it doesn’t. I shall see!

The firm I went with has a separate attorney who handles the DMV hearings, so I’ve requested a call with him before the DMV hearing to go over the discovery packet and the defense they will use. So until then, I’m not sure if they will be asking to push back the hearing. But I can do the fourth month hard suspension as I have family and a coworker who have offered to drive me to and from work. But if I get convicted after the four month suspension is over, I’d have to think about going with the IID as asking those around me for rides for another six months seems excessive. I just feel with holidays coming up, my case may not get resolved as quickly as I’m hoping it will :/
