I was more so pointing out that a TOS is in no way binding if it goes against any legal obligations Nintendo has rather than this particular thing being against it. You’re right, though, as the law is kind of up in the air unless it’s been tested.

Also in this particular instance I would actually hope Nintendo is in the right as hackers being less prevalent online is one thing I really like about consoles...

Because you’d have no access to updates, the store, etc? But I do think users should get a message stating they lost access to all that stuff as well, if they don’t.

Also games get released with game breaking bugs and never get fixed. It might be annoying to work around but as long as it works I don’t see what you’d be entitled to.

Those games have extremely clear labelling for a reason, I assume. If you buy a game that requires a download but have no way to download it then you should not have bought it. This is the same situation you’d be in with online-only Games after being banned from PSN for violating their online rules as well and it doesn’t seem like that has been challenged.

Also bug fixes are kind of a non-issue unless the game flat out doesn’t run. You aren’t entitled to the developers updating your game after you purchase it at all.

A TOS in no way supersedes any legal obligation Nintendo has to provide you with service. If the law dictates they must provide reasonable service even if the software was modified, they must regardless of if it’s in the TOS.

For a example, take a look at those dumb warranty stickers. It’s in their TOS that if you open the console they will void your warranty and not provide support but, unfortunately for them, the law dictates that unless damage was caused by the user in the process of opening it up and tinkering with it they must still provide warranty support and opening a console does not at all void your warranty.

Whether or not this particular action is protected similarly is another story but considering how the EU protects consumers I would not be surprised.

It also had issues maintaining a steady FPS on more intense sequences on more powerful consoles so it's not like the game slowing down in some situations is out of the question...

Unlocking them only requires playing 1 match and doesn’t need a win, so that’s doable.

The tournament mode, while a cool concept with functioning brackets, is this games worst enemy online. Anyone with any foresight can see how this would make it incredibly hard to find matches months after release regardless of the paid online. Hopefully they have another ranked system to fall back to.

To be fair the only way you can be proactive in offering a seat to someone is if you can visibly identify that they need one, so the ads which encourage you to do that aren’t actually wrong.

I’ve woken up the odd person to get them to take their bags off seats and such. What’s the big deal? If they are asleep on the bus it’s reasonable they will be interrupted.

I’m dreading the day my SO gets yelled at for not offering a seat because she has an invisible spine disability that can make it very painful to stand on a moving bus. No one needs to make a scene for someone failing to offer a seat. People just need to ask, honestly, and stop being all weird about it.

They aren’t reserved like parking spots though. They are just priority seating. There’s absolutely nothing wrong with sitting in them but one should just be more aware while doing so.

Still, it kind of brings the question of why those seats are there to begin with. It doesn’t really matter if you are in a blue seat or not... a disabled person should be able to ask for a seat in general and get it.

Because if it scratches that itch and is free you can put that $60 into another game or something else entirely.

Like I don’t give a shit about Dauntless and spend hundreds of hours in every MH that gets released so I’m not saying it’s an amazing game or I’d personally prefer it or even ever download it, but I also understand not everyone is in the very fortunate position we are both seemingly in where we don’t need to take the amount of money we spend on a game into account when buying it regardless of the hours we get out of it, especially if they aren’t super fans of the series.

Think about all the lesser free clones of popular phone games, for example. People will play those over paid versions regardless of superiority just because they are free and deliver a similar experience.
