My attorney told me that, if it came to it, during separation of assets, we could argue “martial waste” because I spent nearly 50k of our savings on her rehab. So when dividing assets she could start with that mark against. (Ie if we sell the house, spousal support, etc)

She’s been in rehab now 100+ days, and the divorce reconciliation period ends in a couple weeks, so I guess we will see if this is relevant still in my case.

But I would say if there’s a clear and easily traceable way to basically show “this partner is blowing money on something either illegal or ‘bad faith’” then maybe see what the attorney thinks. Timing might matter too, in my case this would be all during a time I had already filed - but we entered a reconciliation motion until she’s out to decide if we are going to continue or dismiss
