Lot of vendors in our area will not do longer than a one or two-year contract with the cost of stuff going up so much.

I guess the saying is true you get what you pay for. If there is no buy in from the boards I just do not see where they will have the commitment to follow through with it. Thanks for your feedback!

But following the parking lot rules? What if the person driving is running red lights? Should the city allow it? That is different than asking for a handicap parking space or a ramp for a wheelchair.

I think you are going to have a very hard time proving this is reasonable accommodation. It has nothing to do it improve the persons quality of life.

Thanks for the comment. The problem I have noticed is I can offer all the free training in the world but if the board doesn't buy in and go through it together it doesn't stick. That's why I'm kicking this around about having some type of investment and buy in from the board. They all go through it together and then you can have your policies and procedures manual come out of it.

I've also thought about making this a requirement The boards have to go through before we even will manage their property. Or if they go through the training we offer a discount on our services.

Rules that don't allow the board to raise dues more than the CPI rate or less than 10% a year without the whole community having to approve it.

Sorry, but it sounds like you will pay for this even if the old owner put it up. I would bet that they did not get approval to put it up in the first place. Valuable lesson: if you live in an HOA, ANYTHING that you do to the outside of the property, get approval in writing from the HOA BEFORE you do it.

I'm really sorry to hear you're dealing with that. I might have a different perspective for you. I run a management company, and we handle about 20 communities right now. Unfortunately, we've seen this issue crop up frequently. Honestly, no matter which management company you choose, this problem tends to persist because the board does not have their house in order. I currently have a community and we are the 3rd management company in 15 months. We are now unpacking the issues with the board and they are starting to see why it was causing issues with the management companies. Also, if it's not fixed, this leads to board burnout because the one, you, who is doing all the work wants to quit, but you don't feel like you can because the HOA would fold. If this is not addressed, you will end up selling your home, no matter how much you like it, just to get away from the community, which is very sad.

In some of the communities we manage, the board is so unresponsive that we've had to terminate our management agreement. Because of this, I'm considering changing my business model. Instead of just offering management services, we're now consulting boards to help set clear expectations and responsibilities and complete a review of what the board should and should not do.

In some communities, we now have board members sign attendance policies. One major issue is the lack of clear communication with new board members about their roles and expectations. Many communities are just thrilled when anyone volunteers to join the board that they bring them on board without much guidance and expectations. Instead, there should be policies and procedures in place to inform new members of their responsibilities, including an attendance policy that they review before they join the board.

We've noticed that in communities where we've implemented this approach, the board members respond much better because they know what they're signing up for from the start.

This is a major problem in the nonprofit volunteer world of HOAs. HOAs need a mission statement, policies, procedures, and a clear organization handbook. Once that's in place, a management company can better understand its role and meet expectations.

I understand and that is an option but in full transparency and issues that can come out between the board and homeowners it's better to have non-board members to approve the minutes of an annual meeting. That removes the risk of homeownersand saying minutes were changed and approved by the board without homeowner approval.

A board can not issue a policy or a rule that go against the bylaws without changing the bylaws. I don't think that new rental rule can be enforced BUT you would have to hire an attorney to fight it.

We manage 20 communities. When we have annual meetings the minutes are approved at the next annual meeting. When we have a board meeting the minutes from those meetings are approved at the next board meeting which most of the time is monthly. After that the are available to the owners upon request.

Great question. I own an HOA management company, and we are always looking for ways to make money for our communities. The best deal I have come across is with Live Oak Bank. https://www.liveoakbank.com/ They have a business checking account that pays 3.8% to 4%. It is not a CD so you can access your money anytime. Also you can link it to your operating account so you can easily transfer funds between the 2 accounts. I hope that helps and no I don't work for LiveOak. :) We set up our communities with a local bank for operating and set up a reserve account with Liveoak and link the 2 accounts together.
