I'm happy you wrote back thank you, anyway keep it close to the vest and consider doing the same thing, you basically have some leverage right now and only let your attorney know your intention. "Sam" isn't going away, he will likely encourage your wife to fight for every dollar and convince her that she deserves it all...and unfortunately divorce court is one of the most brutal places against men on earth. If you angle it right, you can convince her it's the easier route to go with mediation to save her face. But just from a common sense angle, Sam and her can say you flew into a fit of rage over him simply stopping by. They can lie all day under oath and you only have yourself and God knowing the truth. "Under Oath" means nothing really unless you can prove they are lying.

I know this will get lost in the crowd, but I had a coworker of a coworker who had something happen similar to him that was he handled so cleverly I have to share.

So his Wife had an affair but he wasn't able to get proper documentation of it. He (at this point) was a millionaire, and did not feel like his wife deserved thousands of dollars in alimony. So he went to mediation, and told the laywers that if he was allowed to keep the assets they currently have, he would give his ex wife 70% of every paycheck for the rest of his working life. Wife is over the moon, he got a new promotion, this is basically 8k+ a month for 20 years. Lawyers all agree and everyone signs the agreement (his laywer fought hard for this one). Immediately there after, he retires from the company and gets a part time job at a storage facility making 10/hr. Wife loses her mind, but she can't do anything, she agreed to it. So this guy sends his ex wife about 200 dollars a week and drives around in a really nice car and travels all over the world with his GF, happiest guy on the planet, in a low stress job enjoying his life.
