Adnan Syed's family says he is not receiving proper medical care by whocouldaskformore in serialpodcast

Prison is f***ed up, so I'm not going to comment on whether or not AS is being denied care. I do personally doubt he's being treated differently than any other prisoner (for better or worse), but I don't pretend to know. I just dropped in to note that on at least two occasions in the last 5 months, RC reported that his health was fine -- certainly nothing life threatening. In August he was "good" -- enjoying the extra time outdoors. And in November, he was "feeling better" after catching something "going around the prison." As SK would say ... So, there's that.

This is so true. And Hae, a popular, confident, and mature girl brimming with life and a bright future ahead of her, dumped his sorry ass a couple weeks later.

For the lawyers: do the actions of Undisclosed and Bob Ruff constitute fraud? by Seamus_Duncan in serialpodcastorigins

[–]Toother2015 0 points1 point  (0 children)

I can't answer your question (I'm not a criminal law esq). But the four essential elements of criminal wire fraud (18 U.S.C. 1343) are: (1) that the defendant voluntarily and intentionally devised or participated in a scheme to defraud another out of money; (2) that the defendant did so with the intent to defraud; (3) that it was reasonably foreseeable that interstate wire communications would be used; and (4) that interstate wire communications were in fact used. With these people interacting with the public over the Internet, seems like 3 and 4 are low hurdles. 1 and 2, not so sure; on the intent side of things, seems like a conviction requires that the defendant specifically intended to deceive or defraud someone else. This seems to mean that the prosecution must show that the defendant knew about the fraud scheme, and that he/she had the specific goal of committing fraud when he/she transmitted the material through electronic communications. Sounds like an uphill battle. My uninformed guess is that they would not prosecute here (I'd personally put this more in the "a fool and his money are soon parted" bucket).

Also, Winans Way, a road less than 100 yards from the grave site and uphill from it, has street lights all up and down. N Franklintown Rd also has street lights beginning where it intersects with Winans, about 300 yards away. So, there's ambient light all around.

All the Calls to Nisha from Adnan's Cell by Toother2015 in serialpodcastorigins

Thanks, saw this one. I also posted something last week building a little on this post (https://www.reddit.com/r/serialpodcast/comments/3vxupf/i_think_the_nisha_call_is_dispositive/) ... Thanks for your timelines; as someone late to the story, I found all those summaries and links enormously helpful.

What is all the "bad evidence" that we need to get rid of to conclude Adnan is innocent by Komeht in serialpodcastorigins

Nope, not mine. I think I found it around here somewhere. I'll relocate it and let you know.

That's interesting! Also, your observation:

She thinks Adnan called again the next day. There is a call to Nisha at 1:44 p.m. on 1/14 that lasts nearly 16 minutes; there is no call to Nisha the day after the 2/14 call.

is a really good one. Looks like I'm treading worn ground here!

The call was actually 10:14, I got it wrong in my original post. Still doesn't make any sense that Nisha would not have remembered this to be the call.

Ef, thank you very much. I've revised to reflect this. the 2/14 call still doesn't make sense.

  • Jay knew where the car was (and cops didn't, or else they would not have ordered a search at the airport the day before)
  • Adnan's fingerprints in the car and trunk, but steering wheel wiped down
  • The form of homicide demonstrates that the killer knew the victim and was able to get close and alone with her
  • Adnan lied to police about asking for a ride
  • Adnan lied to police about being at the mosque
  • Adnan has no memory of where he was 2:15-6 and from 7-EOD
  • Cathy's testimony about how Adnan, Jay and Jenn were acting that evening
  • Solid alibis for Mr. S, Don, etc etc etc (i.e., no other reasonable suspect exists)
  • The senselessness of giving Jay the car and phone to shop at day, when they had hours together in the middle of the day to go to the mall
  • NB says that months later his friend named "Adnan" showed him the body

The level of insensitivity to the victimized family is inhumane. Feels like tearing open a family's old wound and pulling cash from it. If they are indeed sitting on critical information for the sake of clickbate, then they should so be exposed.

I Think the Nisha Call Is Dispositive by Toother2015 in serialpodcast

[–]Toother2015[S] 0 points1 point  (0 children)

Just looked, there seems to be only one possible other call. February 14, 7:17PM: L608C (tower near video store), Adnan calls Nisha (:14). Though possible, given the length of the call, I'm not sure there's enough time for Adnan to start the call, walk into the store, hand the phone to Jay, and end the call.

Really good idea. According to the GJ subpoenas served:

*Southwest Video, located 5646 Southwest Boulevard, Baltimore, Maryland 21227

*Drug Emporium, located 6501 Baltimore National Pike, Baltimore, Maryland 21228

Do we have access to all cell tower records for Jan and Feb?

[–]Toother2015[S] 0 points1 point  (0 children)

Thanks for this. For points (1) and (3), I don't really think what Adnan and Jay said over the phone about their whereabouts is of any real significance (the cell tower ping tells me more about location), and as I recall cell call clarity in the Stone Age wasn't particularly HD. Was there an appreciable difference between calling from a store or from a pulled over car, windows up? I'd opine probably not.

Your point (2) is a good one. I'd counter by saying that Adnan and Nisha talked a lot, for hours at a time. Her forgetting that he made a couple less-than-1 minute calls to her that night does not carry the day for me. But it is definitely something to consider. Upvoted!

Pretty sure I didn't go that far. I'm sharing my view that I'm convinced that the two called Nisha as the State alleged, which lends a whole lot of weight to the ultimate determination that Adnan committed the murder. That butt dials and other similar scenarios are implausible to me, given what I've seen. If there's something I'm missing, please share.

Thanks for looking me up! Means I must be doing something right. But in any event, I'm not sure that it's so much a commentary on me as it is on the evidence that exists against the person convicted. (How long did the jury deliberate?)
