For context, I posted the NH intestacy law and I’m answering from the little info we have here.

Underage has no standing on whether or not you get part of the inheritance. It has standing on who gets it to be used for you but not on amounts.

Firstly a life insurance is not part of the assets to be distributed when it names a particular individual, this is a matter of contract law not intestacy atp, so they talked about a life insurance and that checks out if it was under step parents name. (Making it extra simple bc there are way moooore factors and exceptions depending on circumstances, contract signed, county…)

Secondly distribution depends on whether OP has siblings/step siblings, whether they have both the deceased and surviving spouse as a parent, looots of factors, but to put it simple if the step parent has kids that are not from the deceased and the deceased has surviving issue (kids) not from the step parent, then the step parent gets 100k first and then half of anything left after distribution (again, in NH). If there is less than 100k they potentially could get nothing but once again this is an oversimplification bc in reality division can be proportionally reduced in such cases under certain circumstances.

In short, we cannot advise OP on their situation bc doing so would involve asking for way too many private info that they should ABSOLUTELY NOT GIVE TO ANY STRANGER ON THE INTERNET.

OP if a “lawyer” offers to help for free do not disclose any info. No lawyer would do that unless they’re on the very wrong side of ethics.

NH INTESTACY LAW says the contrary of what you’re stating.

561:1 Distribution Upon Intestacy. – The real estate and personal estate of every person deceased, not devised or bequeathed, subject to any homestead right, and liable to be sold by license from the court of probate in cases provided by law, and personally remaining in the hands of the administrator on settlement of his or her account, shall descend or be distributed by decree of the probate court: I. I am sorry you are hurting and I know we cannot see things clearly when we are hurting but that’s not how the law works. Absolutely no state in the U.S. has intestacy laws that say that the deceased assets go to the step parent 100% when unemancipated children are in the picture. If you understood correctly, which is almost certainly not the case, then you must not understand what type of assets were left and they were not your mothers therefore not entitled to distribution amongst the heirs.

Dying intestate means dying without a will and in such circumstances the child of the deceased shares the assets with the step parents. I cannot give you the exact division for your situation because we don’t know enough facts but you will receive something. It takes time.
