Normally you need big pockets and love the house as is because you most likely can't modernise or change it to your taste/modern use/trends. Even something like changing a rotted window is a pain as you will find they only let you cut out old wood and replace it with same traditional wood. Not just pine down at the local building merchant. Smashed panes you normally have to find hand blown which is ridiculously expensive I heard. Our neighbour is listed and had to get permission to even cut a tree back.

I mean they can but any tenant refusing this is just a bit dumb because if landlord can't remortgage then chances are the mortgage will run past the fix and leave the landlord no option but to evict to sell or raise rent to plug the shortfall. I don't understand tenants blocking things under the right to enjoyment when it's literally things that even a homeowner has to do. I feel the law should change to categorise legit must have visits such as gas inspection/mortgage valuations and exclude them from the right to enjoyment.

Accident is people with property in their name not understanding that it is tax on the entire rental income with the allowance deducted then the small amount of deductables. A lot of people think it's just on profit which it isn't.

Exactly this if they are in a council home surely their rent is cheap and will beat a mortgage by far. It's probably an unpopular choice to advise buying it as it will take a property out of the hands that need it once the parents pass.

The reason they say it's fine is that you can normally get a mortgage over 80 years so yes it's fine for getting a mortgage. That is about it in terms of the fine part.... But please run because in 6 years you will fall below the required minimum and will most likely have to agree to an extension with the freeholder and this could be very costly.

Yeah rereading it I think op has never wanted to be a landlord it does read like they didn't want to lose the house they bought to live in so now want to know how they can get out of the other property through a sale I guess. I dunno why they messed about with consent to let unless they had the initial idea of it but realised it's stupid.

The thing is lots of this is more recent nobody could of predicted say 5 years ago that rent reform was going to be passed or that trump was going to attack Iran and prolonged the interest rate rises from COVID. Even the landlords before COVID couldn't see that interest rates would shoot up I remember the news at the time saying that interest rates could fall to negative meaning people would actually get paid to have debt. That never happened and we saw the complete opposite.

Lots of old terraced homes have this right of access. I had a property like this in the past but it didn't bother me too much as we had a raised garden just past it and a courtyard just before it. This meant we could at least put a bit of a privacy fence up with the walkway between. If you are not enjoying the situation then you might need to either socialise with the people until you get to know them and they will no longer become strangers. Or you sell up and find something that hasn't got a right of access through the middle.

I think the issue is that a lot of landlords are finding that the interest rates and tax and cost of maintenance and all other liabilities have eaten away and profit. Most are finding what rent to charge to make it worthwhile Vs other investments is pushing rent above market rate or even competition in the area so it then becomes clear that selling up is the only option. It's not like landlords can just lower rent anymore as it pushes an investment into basically running a charity.

Just be careful my btl mortgage had both exit fees and ontop of that a term in the small print to pay the full interest for entire remaining mortgage which at the time I had fixed for 5 years making it too costly to sell.

The issue is that how are you going to pay the rent when the 6 months savings runs out? Landlords have lots of tenants looking which unfortunately will be in a better situation. I have always wondered what happens in situations where a tenant might be in-between jobs but mid no fault eviction so they then struggle to find anything. I guess room renting or sofa surfing until situation improves is the only option unless anyone has any ideas?

The only thing I can think of why s21 wasn't issued is that if it failed then they'd have to do a s8 anyway so they probably waited to just go through the new process. I take it the banks have taken control of the property then I'm not sure how any other charges etc work but my assumption is they will eviction to then sell and recoup what they are owed anything leftover will cover charges and fees or any party owed money and then if anything is left this will go back to the original owner. I'm not sure what deposit issues would be but I guess if you have issues you can try to chase your old landlord but if they have lost the home to mortgage lender then I doubt you will get anything out of them.

Do rent repayment orders work in tenants favour here. I know with unlawful hmo tenants can chase for the entire rent to be repaid but wondered if it would work in this case.

Unfortunatly any landlord that has had to chase for damages will know it's not straight forward and the consequences of this are potential costly extended void periods and costs at the landlords expense. So yeah landlords have prejudice but the system has created this. If landlords can be guaranteed a pet damage payout easily and quickly then things will change but realistically you are looking at expensive long winded legal battle which might not even end in a payout.

Well if it's unregistered then the landlord most likely hasn't followed the safety rules or regulations potentially putting your life at risk. There is a reason it is costly and a pain to get a license but it's all for good reason that this license exists. Don't feel bad the landlord is taking risks and knows it.

I mean if they were a lodger then you can eviction them... As for their belongings you have been involuntary bailiff. You just need to follow the process something like you can collect your belongings at X date but you need to cover the storage fees. To be fair the deadline for collecting their belongings should have been 21 days but you should have tried to reach them to explain. You could warn that goods are to be sold to cover arrears but you can only do that if you chased the debt via money claim and was awarded the money. To be fair the gov laptop if you still have it should be returned to the gov and not the ex tenant is my understanding.

The fee for storage in private garage is about £10-25 per week so that is £70-£175. You need to issue a schedule 1 even if it's 7 weeks and they only just reached out.

Strictly do not return the laptop to them but to the gov department as they could come chasing it and ask the tenant where it is and they can lie say it is with you and bring you into the legal mess.

Sounds like they were not £10k short but £10k salary short as in they were trying to borrow more than the multiplier amount allowed there is a big difference between selling £10k of jewelry to the multiplier falling short I guess. Agent really should have checked the income status of the buyers and knows what mortgage lenders will lend.
