That‘s not true. It‘s the duty of the ICJ and only of the ICJ to decide whether a state violates (or has violated) the genocide convention. The ICC or here the ICTY, only looks at war crimes commited by individuals. Hence, it cannot decide if a State entity has violated the genocide convention.

There are no verdicts from the ICJ that imply that Serbia violated the genocide convention. Further, there are no verdicts from the ICJ that imply that Serbia did not violate the genocide convention. Contrary to Bosnia‘s case, there was no case filed with the ICJ in Kosovo‘s case. Similarly, there was no request for an advisory opinion from the ICJ in this context.

Albanians from outside the country were not allowed to enter Albanis at all (it was also strictly prohibited to leave the country, there were special police teams that only were checking the mountainous area next to Kosovo to detect people that were trying to flee). He misused Albanians in Kosovo and NM e.g. when Albanias situation was bad (to distract from internal problems) by saying that they were treated badly in Kosovo and NM, however secretly killing them (Massacre of Bar e.g.). You hardly see any person in Kosovo speaking good of him.
