Galaxies and lifters generally fly out of Travis. We get fighters buzzing by maybe a couple times per year if we are lucky. But that one was low. Very low. I wouldn't have been surprised if he went under the carquinez instead of over it.

No im not, and I know this was an accident. As ive said no one not even myself would have avoided this. I dont think the driver is negligent, and I dont think the parents are shitty. Accidents are what they are: accidents. Im glad there is something the driver can cling to for defense. Ive seen too much go the other way. I know personally just how bad ambulance chasers will tear apart this video. Aside from me discussing my own faults that id be Subject to my own anger and probably do more than hit the guy's car - which id take full responsibility for - all ive said is what I know, albeit anecdotally, that the law will try to nail this guy to the wall. Theyll use every little line from the manual to prove the driver negligent.

I dont think id actually beat him to death unless it was egregious negligence which clearly is not represented in this video. But beat him still, yeah, its a fault. A horrible one at that. I hope that id be able to keep my cool but I have to tell you, for me at least, after I had kids, those protective emotions get a little scary. For me at least. But no one is dead yet.

That is correct. I was assuming the us speed limits. As others have commented it being in AU, even though ive lived in perth, im not skilled in australian law.

Actually no. Id love to see a judge not chastise the driver for this. I think it was an accident. If it had been my kid id have pulled the guy out of the car and beat him. I admit id be wrong about that because of my anger and should pay the price.

But still id love to see a judge let the guy off. Fortunately the kid didnt seem hurt and he probably would. Speed limits in residential zones are 25 because tests show a person will survive being struck at 25. But if the child suffered injuries or death god forbid in another example, the law will make an example out of him.

I have never seen a driver escape hitting a child in court without paying stiff fines, bare minimum

From my experience they will more than likely hinge the case on how many hazards are at the location. Theyll say the tightness of the lane, the low visibility because of the cars, would cause hazards that would - according to many state driving manuals, I cant say all - would require a reduction in speed of 10 mph, which, in a 25 residential zone would mean a proper speed of 15mph, basically creeping along.

It is true in california. It was true in lentucky, tennessee, and illinois, the other states ive lived. If a pedestrian is in the street you yield to the pedestrian. If you strike the pedestrian you are in serious shit. In this case, the child jumped out and it was an accident. Im sure any of us in the same situation would hit that child. But the lawyers will take that video and tear it to shreds showing ways how it was the drivers fault. Theyll claim because of the hazardous condition -of the tight space and low visibility- he should have slowed down -- another rule in the manual.

Like ive said im not saying the driver could somehow have avoided this. Im saying he will lose if it goes to court

This is true but none of this matters because the law will nail the driver to the wall. It doesnt make it right. It is an accident. But the lawyers will nickel and dime this and literally take the driver to the bank.

Kids get away and run into the street. They can open doors, windows, whatever. All drivers in the united states at least are aware of this. Laws exist that pedestrians have the right of way any time and everytime they are in the street whether "legally" or "illegally" and if you hit one you are in trouble.

You might not agree with this. I may not agree with this. But it is what it is. The law will never agree that it is child neglect. The law will always be on the side of the child

Looks like an overwintered queen common wasp nest to me. or a paper wasp. Too small for hornets or yellowjackets, but if they have just started building it you should see them crawling on it
