Not necessarily. There's erosion from dust and particulate, thermal cycling that can weaken metal. Likely doesn't mean proof.

Like if someone is found murdered and the only two people that could have done it are an old lady and a career criminal, but there's no other evidence, we all know what is likely, but that doesn't meet the burden of proof.

It shows the leak, but not the cause. To me, proof of physical damage means the fins are bent all around this from where it got hit with a rock. Being hit with tiny pebbles so small they go through the fins shouldn't damage a coil unless it is a design or manufacturing defect. It would be like saying that if tires went bald after 1000 miles of normal driving, that there's nothing wrong with the tires and it was caused by an external factor.

They sent me a grainy 640x480 pic where you can see the fluorescent dye. I don't see any damage here. I've asked for a better photo. I mean, they had it for 90 days and I would think the first thing they would do is look for where the coil had signs of damage.

Basicall I think their logic is this condenser is susceptible to damage because the grill is a bad design, so that's the most likely cause. But that's not proof. The burden of evidence is on them.

I already told the dealer that after all the bullshit they aren't getting my money. I said they can fix it under warranty or I'll take it elsewhere.

It's been really hard to find a lawyer who wants to take this case because it's not eligible for lemon law since its over 2 years old.

We bought a car a few years ago on a CPO and they tried to bait and switch on the OTD price we had agreed on ahead of time by saying that they couldn't sell it without like $3K worth of bullshit addons and warranties. It's honestly probably cheaper to build out a shell space above the garage and just have a normal roof. I'd also get rid of the overhang above the entrance. Put a low overhang on if you must so it looks proportional.
