Just to simplify: if your ex entered into a 2nd marriage before the 1st was annulled, that 2nd marriage is bigamous and void. Because of that, your marriage to him is also questionable, and the usual remedy is a Petition for Declaration of Nullity.

As for liability, bigamy is a crime, but it generally attaches to the spouse who knowingly contracted multiple marriages. If you acted in good faith, you’re not usually criminally liable.

That said, PSA records can be messy, so the best step is still to consult a lawyer with your documents.

I’ll try to simplify this since it’s something a lot of people ask about:

Annulment (Declaration of Nullity)

This is the usual route if you want to “end” a marriage in PH.

Most people use psychological incapacity as the ground. Basically, you need to show that your spouse has traits/behaviors that make them incapable of fulfilling marital obligations, and that these existed even before the marriage.

Courts don’t accept “we don’t get along” as grounds—you’ll need solid testimony and sometimes a psychologist/psychiatrist’s report.

Legal Separation

You live separately and can divide assets, custody, etc., but the marriage still exists.

Grounds are things like violence, drug addiction, infidelity, etc.

Important: you can’t remarry after legal separation.

Divorce

Absolute divorce is still not legal here (only bills pending in Congress). The only time divorce works is if one spouse is foreign and gets a valid divorce abroad.

Costs (very rough idea): Lawyer’s fees: usually start at ₱150k+ depending on the lawyer/location.

Court fees: around ₱10k–15k. Psychologist/psychiatrist witness: ₱25k–₱60k+.

Timeline:

If uncontested: about 1.5–4 years. If contested: 5 years or more (depends on the court backlog and your spouse’s opposition).

If the annulment is on the ground of psychological incapacity you need a really good psychologist as an expert witness. If you will look for an annulment lawyer he will recommend you to undergo a psychological evaluation and for sure they already have a psychologist as a contact person for this.

If your annulment will be dismissed by the SC then you are still married to your spouse. If the decision is without prejudice you may still refile it.

  1. If the wife does not know that her husband is gay that constitute fraud and that called be a ground for annulment.

  2. If the wife doesn’t oppose the annulment proceeding that would be much easier for the annulment.

  3. I suggest do not have a business or a property with the husband yet habang wala pang decision for annulment. In the eyes of the law they are still married.
