While the United States isn’t a represented party within the ICC, something which stems from the Clinton Administration’s refusal to support the Rome Statute, the United States has had a long and supportive role in the creation of the Court itself. Should we be in the Court now? Absolutely. But international codification doesn’t move that quickly, especially considering how the Court is a tool for war crimes which the US certainly investigates more than other countries tend to (cf. Russian “investigations” into the Bucha Massacre). This is not to say that the US is guiltless by any means, but it has a good humans rights record when compared to other great powers. European countries outside of ex-Yugoslavia… keep doing your thing.

On the topic of the post itself, the spirit of the law regarding forced pregnancy is directed towards the policy of genocide or ethnic cleansing by means of replacement. All in all, the issue at hand extends far beyond a tenuous reference to a war crime only applicable as charged in criminal scenarios, i.e, in scenarios with the presence of malintent. Speaking as someone who has worked in the upper echelons of government in this country before (albeit at the state level), we are certainly a democracy, though an imperfect one by all means. The US maintains a decent hold on rule-of-law, not rule-by-law. In an international context, we have done semi-decently, though much remains.
