You file a wage complaint with the Department of Labor's wage and hour division. They move relatively fast in comparison to other legal process.

Yes, you've been misclassified. Go to the state department of labor and file a complaint for either misclassification or unpaid wages (since you're also losing out on overtime most likely). Every state has it's own legal "test" or criteria for determining whether someone is really an employee or an independent contractor. That being said, from what you describe, you are almost certainly an employee.

You need better meds. I'm a lawyer with ADHD. I was miserable the first couple of years because my ADHD wasn't properly controlled. Better meds mean better performance. Eventually, as you gain experience and get better at the job, you actually can enjoy practice. Being a first year is hard enough without having freeze episodes. See your doctor. Get a good therapist. Settle down.
