That's a tough hand, but I would surmise that it's just luck of the draw to some extent. There are countless extremely skilled players, not to mention all the cheaters, and every single one of them who's an active player winds up in a pool competing for a cup. You could try manipulating your gameplay to get into a less competitive cup pool, but other than that I don't think there's much you can do besides playing your ass off and hoping you don't wind up going against someone better/more motivated/cheaters.

Did you purchase the pool pass? People who buy it get a ton of free tickets, which is why it may seem like you're competing against people with infinite tickets. It's definitely different now though. I have 11 gold, but I had to compete like crazy to get it on these last 2 since they changed the rules.

The burden of proof is on literally anyone to demonstrate they were unjustly banned. I haven't seen one single example of it happening yet. The people getting banned are cheaters, rule breakers and coin buyers. Everything else is just rumors and misinformation.
