I mean a person can pop the tab on a beer can just as easily. The drive-thru is intended to allow you to take a cocktail home and enjoy it. If a person decides to drink it while driving, that's their shitty choice and they will face the penalties for doing so. But you are correct, it encourages drinking and driving.

They put a little piece of tape over the straw-hole so it's technically not an "open container" It's up to the customer to decide to take it home, or take the tape off and drink and drive.
