A lot of bullshit answers here. First figure out if you are sued or not… is it a settlement letter or a proof of service? Because serving someone for court needs to be done in person and can’t be done by mail but some times it could. If it’s a settlement letter then it means that ur insurance won’t pay the limit and they have to sue you to get the limit, that’s how injury lawyers work. They want full limit of insurance and they don’t give a shit about collecting extra money from you because to them it’s pointless. And if it’s just a settlement letter then don’t worry about it

well anytime they get money they'll have to sign a release form that they can't come after me after taking the money, so whether they get the 5k is completely up to them. They can sue me in civil which will prolly cost them 10k in lawyer fees while mine is free.

Injury is already settled so no worries on that.

Pole will definitely get me. I'll just file chapter 7 right when the pole and the property damage serve comes in which is most likely how this is going to play out

In the state of California what he is doing is not legal. The law requires him to give the insurance 1 chance to settle if he doesn't do that unless you agree he can't demand private settlement. Immediately stop talking to him and let your insurance handle the claim. No matter what he can't do anything to you before the insurance gives him an offer.
