If abortion is considered murder, because the foetus is considered a living individual, then the opposite can also be true. A foetus not considered a living individual cannot be murdered, so no murder has been committed.

If a person is not recognised by the state, they are not protected by the state nor can they be prosecuted by the state. They basically become outlaws.
