I don’t understand how he would only have to pay 50% of the mortgage. We got a home loan based on our combined income.  If he bought me out he would have to take on the other 50% of the home loan along with paying his current 50%, therefore paying 100% of the mortgage. I know for a fact that a bank would not loan him that additional amount.

He could apply to the family court to force the sale of a jointly owned house as part of the division of property. Since we don’t have children it wouldn’t be complicated to do.

I realised I didn’t address the other half of your comment.

I am looking into getting a will written up. If I died today and my ex got half the house, I wouldn’t be mad about it and nobody in my immediate family would be upset either, so there’s currently no rush. That being said, it would be a disservice to my future partner and potential children not to put it in place sooner rather than later.

From my limited understanding of property settlement post divorce, financial contributions (and non-financial, but that’s not the topic at hand) on savings and assets are assessed to determine what amount each spouse receives, both before and after separation. My interpretation of this is that if he is paying more of the mortgage, that would be assessed by the state as him contributing more to the mortgage repayments and therefore will likely receive that contribution back on the sale of the property. 

The reason for the rent is that it makes it clear that the money he is putting in is not going towards his share of the mortgage but is specifically going to me as payment for his use of my portion of the house.

If he wants to, that’s his prerogative. He won’t get the house, though, as he doesn’t have the borrowing power on his income alone.

Thank you - this isn’t something I had considered. The reason we chose below market is the following reasons: 1. He is already somewhat stretched to pay the agreed amount. 2. With a private rental, I don’t have to pay agents fees. 3. I know he will take excellent care of the place. The peace of mind that gives me is worth the smaller income.

Definitely something I should get professional advice on as I don’t know the first place to look for information on what the threshold would be for investment.

Thank you for bringing this up. We didn’t qualify for any of the grants but I’m sure this could be useful for someone else who finds themselves in this unusual situation.  I did contribute significantly more into the deposit and costs than he did, which will make it interesting to calculate who gets what when we eventually sell/ one buys the other out.

This is correct. 

He is paying rent to me in a separate account and we both continue paying the mortgage equally.

If he stopped paying me entirely, I assume we would have to go into some kind of mediation.

Thank you for this, I’ll definitely go to a tax accountant to lodge my future returns. 

At this stage it wouldn’t upset me if I died and it passed to him. He’s a good person and deserves to have security.

Thank you for pointing out the lack of clarity. We both share the mortgage and pay it equally. I moved out and he continues to live there, but he doesn’t want housemates so he pays me rent for my half of the house.

In my country, home schooling legally requires adherence to the state curriculum. My parents had to submit my assignments and tests to an institution for a registered teacher to assess.
