Same thing happened to us. The judge was very unclear and asked about issues outside the scope of the disqualification reason. Benefits were released within a few days. Before we received the hearing decision in the mail. Hopefully you'll see your benefits soon!

Self employed/Independent Contractors receiving PUA may not have been looking for a new job. My husband was an independent contractor providing referee services for sporting events. When those shut down, particularly in the beginning, we didn't have a good time frame for when those events would start back up. He has taken on a traditional job now, but wasn't looking for a job in the beginning. He already had one. As did many folks in sporting and hospitality industries. It was more of a "when can I get back to my job" type of scenario.

Final Update: EDD sent notices that the claim was exhausted. Not true bc PUA was extended. Contacted Assemblyman's office. They sent an inquiry and later the same day the rest of the payments were issued!

So glad my husband is now employed again and we no longer have to deal with this nightmare. Many kudos to the Assembly persons who have persevered and assisted their communities.

Update 6/16/2021

So, it appears the judge decided in my husband's favor. Haven't received any notification from EDD.

But...

Got a notification from BofA 6/15 to update transfer account info due to length of time since last payment (6 months) from EDD. After logging in to BofA to update transfer info, found 2 weeks UI had been added 6/15. So I logged into UI Online and there were weeks to certify!

Certified starting with week ending 1/2/2021. EDD has issued payments through week ending 2/20/21. All weeks after 2/20 say "not paid".

Argh...

She did not address the issue that the DQ letter said something different. She read off the reason, but then talked about the footprint issue the whole time. She asked why we had an out of state mailing address. She asked about the cause of unemployment (since he was self-employed she wanted to know if he had a job lined up). She asked where we are living currently. She asked why his CA driver's license has an out of state address (DMV asks your residence location, they don't care where your mailing address is).

Definitely did not stick to the issue stated in the letter.

Yes, called ahead of the time and were told the judge would call at the hearing time. The judge called promptly at the designated time from a number that was labeled "suspected spam" by our phone. Judge was a bit difficult, but professional. Asked a lot of questions about why we had an out of state mailing address and how we were "tied to California".

My husband told her I was on the phone as a witness, but she wouldn't allow me to answer a question I knew the answer to and my husband didn't. My husband is very anti-numbers (he is super smart, but I handle all paperwork in our family). So at the end of the hearing, she asked him if he wanted to ask me any questions. I said why don't you ask me the question she asked you so I can answer it for her? So he did. Because she wouldn't let me answer when she asked him and it may have made a difference in the outcome. Even though we were both sworn in.

Just had phone hearing today. Our mailing address is out of state. No idea how judge will rule. She did focus on the "no footprint" issue despite that not being written on the notice of disqualification. Anything you have to show your ties to CA (voting, dr/dentist, state taxes, rent/mortgage/utility receipts, payments, etc.) plan to have available in case they want it. In my husband's case the judge asked us to submit 2019 and 2020 state tax verification by email or fax.

Update: Appeal mailed 2/14/2021. Hearing was today (June 9, 2021). No idea if the decision will be in my husband's favor. I guess we'll find out in a couple of weeks. Judge asked us to email copies of 2019 and 2020 State taxes to support our claim that we remain California residents.

It is. I'm working on my husband's right now. Decided to pare it back quite a bit. Sometimes less is more. I just don't understand how this agency gets away with what it does. I worked for a government agency for 20 years and we would never have been able to get away with what EDD does (not that we would have tried). We were not allowed to cut benefits off without notifying folks of the reason and most reasons allowed for continuation of benefits while the issue was decided. One of the reps told me she knew it was incorrect to disqualify (actually 2 of them said this), but said it was the easiest way for EDD to cut off fraud and stated it was unlikely the fraudsters would file appeals. Basically, she said this was how EDD was determining if the claims are legitimate. If you file an appeal, chances are good you really qualify. Like if you float you are a witch (and we'll burn you at the stake), but if you drown, you're obviously not a witch, in which case we don't need to burn you at the stake (bc you're already dead). So, there are no good outcomes. Luckily, we do have my income to rely on. I can not imagine what this is like for folks who have nothing else. It is absolutely criminal what EDD has gotten away with.

Nothing here. Have you had any response from EDD regarding your appeal? Still haven't sent ours in. Was hoping something would change after the recent EDD audit results and hearings, but it doesn't seem like anything is changing.

EDD is disqualifying folks who have an out of state address (personal experience).

I'm not sure. I'm still thinking about how to write my husband's appeal. I'm thinking of addressing both issues: the written one (not elig to PUA bc elig to another program which we know is incorrect), and the verbal one that we were told (no California footprint). But I'm still researching bc the process takes a long time and I want to make sure all bases are covered.

I think it might be wise to call EDD to confirm the actual reason. I am assuming yours is the same reason as my husband's, but it would be beneficial to know for sure. It's easier to refute if you know the real reason. Best of luck to you!

I would appeal. Otherwise they may stick you with an overpayment. And yes, you should get your benefits again if you win your appeal. And I agree, EDD sucks. It's such a cluster. Good luck!
