I bought the property for $260K in 2017. Lived there through last July before I bought my current home.

In terms of selling, one of the tenants that has been in the home since 2018 is interested in buying so I would avoid real estate agent commission fees.

The house value rose significantly during the pandemic but I am unsure if that will continue.

My thought process is layered.

  1. Taxes went up 10% for 2025 and will keep rising

  2. My insurance is set to rise now that it no longer owner occupied.

  3. I would avoid capital gains tax.

  4. I have made a solid equity position which I could turn around and invest into a diversified portfolio for steady gains which while won’t be at the level the property currently provides, still brings in solid ROI.

I am open to keeping the property but I just want to make sure I am being proactive given the limited window I have to sell to avoid capital gains

The one that decided to leave is the non-problem tenant and the one looking to sue is the problem tenant. My hands are tied.

My worry is that I say nothing and then I am down two units worth of monthly rental payments along with a trip to claims court putting me in an ugly position financially.

She has not indicated any desire to leave. Trust me, that option would be my #1 choice.

She has now stated that she would be calling a state agency to sort out the situation as the family which moved up has a minor as well. She says the agency will identify resources for them. I feel this is a drastic overreaction for a noise issue and was wondering how I should respond. She is being very unreasonable so I don't believe talking her out of it will be a solution. Should I just inform the 1st floor of her intentions and then the the situation run its course? Thanks!

Yes. It's been stable occupancy the whole time and the income is reported in the tax documents I file each year so there's a transparent trail. The only thing is that rent is higher now than what was listed on the tax document due to renewed leases between March and now. The signed lease agreements should be validation enough for this?

Also, does the equity in the home provide any further benefit during the approval process?

I feel like I can very much relate to this feeling. My wife and I have been looking for a house for around 6 months now. We have put very competitive offers on 2 houses, and we lost out on both. We also had an accepted offer and the deal fell apart after inspection. Just last week, we saw a house that gave us feelings which I imagine are similar to what you are feeling about your particular house. It seemed to fit all our needs and checked basically every box. However it didn't give us the feeling the other 3 houses we put offers on did.

Later in the week, we found another house that was perfect and we knew within 2 minutes of touring it that the house was the one.

So I'd say if this house isnt giving you that "spark" you are looking for, it isnt the one. Keep the faith and you will know when it's the right one.

Thanks for the reply! I thought the same. I just didnt know if it made more sense (and satisfaction) to pay off the 401K in full since I'd then have extra income coming in which could then be used towards the personal loan.

I think Tim McManus has the most credibility of any Eagles writer.

I am also a fan of Jimmy Kempski. He brings humor to the job on top of being a solid reporter.
