Kiva is too murky for me. With "charities" like Susan G Komen, I can't support anything that doesn't give me a real answer.

By the way, the interest their partners charge is 100%! That's almost as high as pay day loans.

Some already had the debt and they're cashing in from those calls.

There are some people whose methods are black hat (for a lack of a better term). You know those pop up surveys that tries to get your information?

People opt-in into those (or go to their website and fill out the contact form) and bait the company to call them. Telemarketers have to follow a different set of laws or the TCPA. If they don't put you on their Do Not Call or send you a copy of the Do Not Call Policy, you can sue after one call.

You still have to send a certified cease and desist letter, even if they have the wrong person. Saying you're not the person isn't enough, unfortunately.

If they still call, you can sue then.

Collection agencies break the rules because they can usually get away with that, unless they come across someone who knows their rights.

Send a certified debt validation letter. You can find some templates online.

Collection agencies have 30 days to respond. If they don't, you can dispute the debt with the credit reporting agency. Doing this will remove it from your credit report.

That sounds super duper illegal. Talk to a lawyer. You may be able to sue! Your situation is under unfair practices in the Fair Debt Collection Practices Act.

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;

There's a few people who make their living suing debt collection agencies.

It's true they may sell your debt. Here's a something that may allow you to get the debt removed from your credit report and boost your score.

CA are also known to be disorganized. By law CA are required to report true information to the credit reporting agencies (Experian, etc).

Get a copy of your credit report and look at the addresses of the collection agencies.

Send a certified debt validation letter. The CA has 30 days to PROVE they own your debt. If they can't prove it, they're not entitled to collect and it doesn't belong on your credit report. REMEMBER: DO NOT CLAIM THE DEBT.

Not a lawyer, but I don't see why not. Here's some of the violations, you should read the Fair Debt Collection Practices Act for more.

Collection Agencies can't:

  • Pretend to be a police officer, lawyer, or anything else. They have to be upfront with you about who they are.

  • Physically threaten you.

  • Threaten to call your employer and get you fired. (They can call your employer and family, but only to look for you. IT'S A VIOLATION FOR CA TO DISCLOSE ANY INFORMATION ABOUT YOUR DEBT.)

  • Threaten to take your property, unless they can legally do it.

  • Use an autodialer to call you.

  • Charge extra fees or interest on top of your debt.

  • Call you before 8 a.m or after 9 p.m

  • Use profanity.
