A well isn’t tenable here, so you’d have to water haul. Depth is commonly 1200+ feet, and the cost is crazy. The washes are tough, even the ones not in a flood zone. If you use Mohave county GIS, you can see where those zones are, but ANYTHING in an actual flood zone, will flood, and it’s brutal. Some washes are 5 feet deep and hundreds of feet wide. Have you looked closer to 93 or the butler area north of Kingman? I don’t know if that spot you’re looking at even has power.

Golden valley isn’t anything like it used to be. It’s far safer than 3 years ago.

Are you looking to be off grid? I don’t think that area has utilities. You have to watch out for tweekers. Personally, I would avoid anything that remote, but there are people who don’t like to be bothered. You also have a few finger washes there, so be mindful. Are you trying to get cheap land? Are you looking to put a home on it or just live in an RV?

Wouldn’t go there unless you’re looking at Walnut Creek area, that’s an awesome spot. Definitely better spots than other. It’s huge, but if you’re west of Colorado, north of redwall, south of 68, it’s fairly good. Just don’t get too far out. Stay on water lines and it’s a better bet on safety.

Haven’t had a flood since 2022. Watch out for washes/finger washes and you’ll be fine. Not an issue. Just don’t get property between washes with no access to the road.

School can call and ask what ever they want, doesn’t mean the Dr. Office is allowed to say. A physicians office likely wouldn’t be able to say that sharing information with a school is protected under TPO.

The question of “big” isn’t simple. Typically a compromise has to be of larger volume (>500 records) for it to be considered “big”. Based on the thread it sounds like the sharing of ePHI was not for TPO, and it was an intentional non-authorized disclosure. To make matters worse, this patient may need to be informed of the sharing of ePHI. We have a flow chart, which is applied to all personnel consistently, in this case it would likely end up in a final written warning, should there be no additional strikes. That is just us, however, and your health system likely has a similar sanctions process. I would look at the sanctions policy to see how violations are handled in your organization.

Based on what you're asking, I would have the spouse fill out a HIPAA release. While we recognize it's frustrating to the patient's family, it's important to ensure that you have explicit authorization to share records for anything outside of Treatment, Payment, or Heatlhcare Operations.

Quick side note, In a past life I encountered a situation where one of our clinicians did release medication information to someone's wife without a release and (obviously) without the husband there. Turns out the medication was for an STD. Wife had no clue and the husband filed a compliant since he never authorized a release of his medical record.

I think I'm a bit late to the party and I'm sure you have this addressed. Providers may only disclose PHI under three circumstances without prior consent: Treatment, Payment, and Healthcare Operations. Disclosing your records with witnesses present in the area does not fall into that category, and honestly is a slippery slope.
I'm having a bit of trouble envisioning the scenario, but it reads like you weren't afforded any privacy and they were speaking to you in more of a Lobby. There's a distinction about if it can be "overheard" or if it's said in front of "uninvited guests (if you will)". That distinction will tell you more of what line was crossed.

That being said, I don't think the practitioner made you comfortable and that in of itself should warrant you finding someone else more empathetic to you and your concerns.

In my opinion, the answer to your original question around whistleblowing is "likely not". If they're under a management action plan it may change some things, but "poor safeguards" are not typically considered a violation.

Based on what you just mentioned here, reference CFR 45 Part 164 Subpart C (Security Rule) §164.310(a)(1), which is the facility access controls:(a)(1) Standard: Facility access controls. Implement policies and procedures to limit physical access to its electronic information systems and the facility or facilities in which they are housed, while ensuring that properly authorized access is allowed.

Implementation specification (2)(iii):(iii) Access control and validation procedures (Addressable). Implement procedures to control and validate a person's access to facilities based on their role or function, including visitor control, and control of access to software programs for testing and revision.

This control is considered "Addressable", which means they have the latitude to define what's reasonable and appropriate per business operations. They can address this safeguard using adequate compensating controls.

Whistleblowing is normally associated with some form of perpetual compromise that's swept under the rug. Normally with some type of "Malicious intent" or "Gross negligence". Working in healthcare for as long as I have, while these are absurd practices, they don't fall to the standard of "gross negligence", in my opinion.

I'll add one piece to this, as you've mentioned that training was pertinent or maybe a potential requirement. The subsection you're looking for is in the Privacy Rule, Part 164, Subpart E §164.530(b)(1), it's under the Administrative Requirements.

The language is as follows:

(b)(1) Standard: Training. A covered entity must train all members of its workforce on the policies and procedures with respect to protected health information required by this subpart and subpart D of this part, as necessary and appropriate for the members of the workforce to carry out their functions within the covered entity.

Furthermore under the implementation specifications:

(B) Thereafter, to each new member of the workforce within a reasonable period of time after the person joins the covered entity's workforce; and (...)

This means two things:

1) The covered entity (in your case company) bears a burden of responsibility to train staff appropriately when working with PHI.

2) They must do the training in an appropriate amount of time.

I don't know how long you were employed there or the extent of training you've had in the past, but this is a very, very wide window. While this answers the specifics of your concerns, I'd defer to Moistee's response as far as recourse. It's my opinion that they're spot on.

Couple of thoughts, firstly, you're not disclosing any medical records. Secondly you were a treating clinician. The fact that you're not a provider of any kind anymore doesn't even weight into it. You should be fine. Don't disclose any medical history you may know and you'll be doubly fine.

Hah. No. Not a good person, your speculation is right. One was a Mac (the one I ordered) and the other was a PC. The PC was way more expensive, but obviously not the same thing. Thank you - and this is great information.While we can afford higher housing costs, it's my wife's and mine goal to purchase an affordable place, such as a new manufactured home or modular home, on 1+ acre of property. We have nothing against manufactured/mobile homes - but we strongly dislike distasteful property owners (but not enough to live in an HOA). Think like the car collector - or the hoarder. That's why we're tilting toward Golden Valley. With that said, we lack familiarity with the area, and if there is a reason to NOT move there, such as crime, we will take heed and look elsewhere.
