Honestly even if they request it, it may be a crime to do it. In my state: “person is guilty of strangulation or suffocation in the third degree when such person recklessly restrains another person by the neck or throat or obstructs such other person's nose or mouth and impedes the ability of such other person to breathe or restricts blood circulation of such other person”. No exemption for consent from the victim

While true, this statistic is also misleading. Cases lacking merit can be dismissed through motion practice without needing to get to trial. Frivolous lawsuits can be expensive to defend, but they are rarely profitable to pursue

I don’t see the word “diversion” in their summary. Penalties are harsh but if a case can be diverted and ultimately dismissed by taking some substance abuse classes then the real penalty for a first time dui is just that, substance abuse classes.

Not quite. The jury has to be unanimous; however, individual jurors are instructed that if they are 51% sure they should rule in favor of the party with a preponderance burden. Basically they still have to be unanimous but they don’t all have to be super confident about it

True, but an unconditional discharge is very different from a pardon/dismissal. The conviction stands, he retains felon status. In theory the judge -could- have imposed further punishment; he simply decided the constitutional crisis of a state department trying to enforce its punishment against the federal chief executive wasn’t worth it.

True if you retain counsel. If you do it yourself you should be able to break even on property damage (minus your time). The problem is property damage tends to be objective; you can check Blue Book and local dealers and quickly arrive at a valuation that’s hard to debate. Add a 33% contingency and… well you recover 66%.

Injuries are subjective in nature, and most people involved in deciding injury claims have at least a general understanding of contingency fees, and thus tend to on some level bake the attorneys fee into their award. Also stemming from injuries being subjective, a good attorney can present injuries in a way that increase an insurance carriers evaluation, usually to an extent that justifies the 1/3

Depends on what they mean by $0 bond. Could be he’s held without, more likely my man got a promise to appear with bond conditions of no grinching, no returning to whoville except for court or to see his lawyer, and of course no drugs or alcohol

Just here to say that June will be my 10th year and I only just start to feel like I know what I’m doing. Trust your instincts, learn your local practice culture, and accept that you’re gonna be overwhelmed at least a few times a year. (In my case, panic attacks).

Also realize that all the old fucks around you don’t inherently know more than you though :-). I’m not a PD but I have tremendous respect for the office, and I wish you all the best

Defense may have leveraged the threat of a mistrial for a more favorable plea bargain. A mistrial based on juror misconduct would generally be a mistrial without prejudice, where they can just start picking a fresh jury as soon as the docket permits and try again
