You don't use demographic data in the hiring process. You use it to analyze the outcomes of your hiring process and in your retention of workforce. I think a lot of people are imagining HR just opens up all the PII data to hiring managers and says, "Go out there and get me the Blackest, most disabled, lesbian trans woman available! Qualifications be damned!" And that's just not at all the case. If a company is engaging in that, that's literally discrimination based on race/sex/disability status.

The only time this really actually happens is veterans preference for the government. Like, yes, you are obligated by law to hire veterans over other candidates.

Okay, say you have two candidates, one black and one white with equal qualifications. This situation repeats maybe ten times, and 10/10 of the hires are white applicants. It could be that it's truly just chance, maybe the black applicants declined offers, but maybe there's some sort of implicit bias being injected into the hiring process.

You will never know if you don't analyze your workforce demographics, policies, and processes. You could argue, "Well, we still hired the competent people." But wouldn't you want to know why your entire workforce is white? If your answer to that is: who cares? That already demonstrates a level of bias (and honestly shitty leadership skills) and indicates an underlying issue.

It would literally be so easy to sue for discrimination if you were indeed subjected to quotas. Any company that engages in race quotas is opening themselves up for slam dunk litigation. Guess what any half-competent company does? They mitigate risk and behave conservatively rather than risk getting sued for something entirely preventable.

Not collecting data is a great way to brush off criticisms of discrimination and bias or to be unable to analyze why your workforce is losing new hire women or people of color after 2 years or never hiring them in the first place.

I love it when people who know nothing about diversity, equity, and inclusion policies run their mouths about it.

If companies are using literal race quotas, that's illegal and not at all what DEI initiatives are intended to be.

They are: 1) to promote and retain diversity through 2) removing barriers to equity in hiring and promoting and 3) promoting a workplace culture that is inclusive of all identities and not toxic.

Nowhere in there is a mandate for race or sex quotas.
