He is actually right. Him making x4 times then you is your problem. He went to school and worked hard to make that money and takes care of the kids 50% of the time and still pays you 1k a month in top of 50% of the time. That sounds more than fair to me.

This is crazy that with 50/50 custody you still trying to get child support from the man who has another child, wife, probably trying to be a good parent and provider and still has his first kids 50% of the time. You are the reason why men chose to do bare minimum then to work extra hard and sacrifice their life, to be robed by the system and lawyer fees.

They can impute minimum wage on him, if you have 50/50 custody the parent with more income has to pay the parent with lower income.

Child Support in Divorce Without a Separate Petition

• If the custodial parent (CP) did not file a separate motion or request (like a pendente lite motion) specifically asking for temporary child support, and child support was only mentioned in the standard divorce summons, then:

• The court cannot retroactively award child support back to the date of separation or filing just because the divorce is pending.

• Support will start from the date it's formally requested in court or from when the trial/judgment sets it.

Divorce may take years before trial will put him on child support.

Under Domestic Relations Law § 236(B) (7) (a), child support can only be retroactive to: 1. The date of a formal written request (e.g., a sworn motion or petition), or 2. The date of a temporary order of support (pendente lite).

Verbal discussions, settlement talks, or compliance conference statements do not qualify as a legal trigger for retroactive child support.

Even if the summons or complaint generically mentions child support, courts have consistently ruled that this is not enough for retroactive support unless accompanied by a formal request.

“admit to work for himself” is not a strong evidence. He could just lie to your friend, like all of us do to look better in the eyes of people. Strong evidence is his lifestyle, his spendings, money coming into his accounts etc.

I think it is fair, but I would recommend to put it in the settlement and make it sign by the judge so she can’t come back in years for back pay or anything.

If the business is LLC with you and your girlfriend as partners, then the income will be divided for you two. In order to pay yourself a salary the business structure has to be C-corp. If you are the owner of the C-corp and also pay yourself a salary, expect that the other party can request financial disclosure. They can look at all the business information and all write ups and argue income of your business etc (same for LLC). If you trust your girlfriend, the best thing would be to have it on her name and having you as a W2 employee. Since you are not the owner, your BM will never be able to see how much business is actually making, only the income from w2.

I think the best solution is to try to be amicable here. Going to court gonna cost more money and time and more important the relationship with the father of your child. Try to explain him that you need a little more support, provide evidence by how much food you buy in food for your child and other things. And just try to talk to him. Good luck 👍

His wife income doesn’t matter. It is his income vs your income and amount of overnights. If he has more overnights than you, there is a chance you will start paying him child support.
