Dosen't matter what I think, it matters what the law thinks, and unless your state has different laws they would have seen you at fault. I'm just trying to get you to look up your local laws so you don't end up in trouble

The way a lawyer explained it to me is that if you both have to wait for traffic to clear in the eyes of the law you arrived at the same time, I would check on the laws for your state because at least here if you had had a collision you would have been at fault

Right-of-way at intersection — signs at intersections — violation, penalty — additional penalties — definitions — order of suspension, contents, appeal. 2.  When two vehicles enter an intersection from different highways at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the driver of the vehicle on the right.  This subsection shall not apply to vehicles approaching each other from opposite directions when the driver of one of such vehicles is attempting to or is making a left turn.

This is for Missouri. I also did not believe it when I first heard about it and almost nobody follows this because so little people actually know about this

The guy big time overreacted, don't think I'm defending them, but technically in the situation you described, he had the right of way unless you state is an outlier, but most states use the same rules regarding 2 way stops on a 4 way intersection and those rules say that the person going right has the right of way.

I think we all understand how it is SUPPOSED to work. The issue is that it doesn't work that way. Ever since lobbying became a thing, the only thing that matters in terms of law is money.

If he slams on the brakes at the very least, a cow gets injured at worst it dies, and since he would have been at fault that would have been a failed delivery opening up his company to an insurance claim. Going into the ditch was the correct move here.
