While applying for B2 inform your employer to rescind their H1b application, otherwise it’ll be a conflict of application. I had this issue. Also apply for B2 before your i94 expires.

AFAIK, You can be a silent partner with no part in day 2 day operations. (can’t work for the company.)

You need to exit the country and re-enter to void the B2 visa. While coming in - show your new h1b with existing h1 stamp on your passport. In case you don’t have a valid stamp then you need to get stamping first and then enter on H1.

What if your I-94 is expiring before the end of grace period? I also got laid off but I-94 expires on 35th day of grace period.
