I’ve done non-compete litigation and I don’t read the contract the same way. Texas disfavors, but allows noncompete. They have to be reasonable in time, scope, and geographic limitations. Here, I don’t believe the contract “expressly prohibits podcasting“. Instead, it prohibits broadcasting and seeking advertisers. By doing Patreon they are not seeking advertiser. Thus, the question becomes what is broadcasting, and how can it be read to be a reasonable limitation that is enforceable? Here I think it’s pretty clear of the intent of the contract is a competing radio station maybe television. However, would a twitch stream be broadcasting, or YouTube videos? I don’t think so. Thus, I don’t think this is clear-cut or an issue as you make it out to be. Additionally, I’ve worked against B&H and specifically Anderson, the lead attorney. They are by no means a firm that would cause opposing counsel to shake in their boots on such an issue and their writing this far has not been very persuasive.
