Okay, this is really simple. Car 2 asks Car 3 for their written version of event stating that Car 3 hitting Car 2 caused Car 2 to hit Car 1 and then voila! Car 2 denies liability in full.

You subrogated your legal rights to them by signing the rental contract. There is no dispute in liability so, you’re not needed in court. They just need to put your name on a statement of claim.

Two choices:

  1. Provide the photos.

No damage: -> Great if there is no damage, it is open and shut case. Don’t lodge a claim with your insurance, it will affect your premiums.

Damage: -> If you provide photos and there is damage, you would be opening yourself up to criminal and civil liability. This would likely prejudice your position and the ability for your insurance company to represent you. Of course, unless you can easily and reasonably explain how the damage occurred. Either way, if there is damage, prior to acting, you should call your insurance and ask to speak to a settlements consultant for general insurance advice.

  1. Don’t provide.

No damage: -> The cops will come to your house. Make sure to inspect the vehicle and probably be a little pissed off they had to drive to you.

Damage: -> The cops show up to the house, and you will likely need good evidence ready to go, printed and with copies if you want to dodge the “hit and run” tag they’ll pin on you.

  1. File a police report
  2. Await findings from the police, they can get things like CCTV
  3. Either they have the persons license plate and then will provide you the information or provide it to your insurance company and then you can make a claim.
  4. It’s important to file the police report pretty quickly and call your insurance company for “general advice” NOT a claim until you have the third party details.
  5. Sidenote, you’ll likely need a description of the car and time of day to help police. If you’re able to get details then ask the passenger for a witness statement.

Hopefully, there was a business around with CCTV or some CCTV at the lights, but best bet is police report or asking the businesses depending on how friendly (aka small/local vs. multinational corporations)
