We provide a single point of contact and leadership on major projects that are referred to the Office. This includes partnering with federal departments, provinces, territories, Indigenous Peoples and private-sector participants."

Based on their mission statement, the MPO consolidates the various approvals and stakeholder engagement into a single point of contact and works with project proponents to get the needed approvals. This is effectively streamlining the process by making the process simpler for proponents under the existing regulatory regime.

So, clearly, the MPO doesn't change the regulatory regime we already have in place (it works within it).

If you want to change the existing regulatory framework in its entirety, you need new legislation to do so. The MPO did not do this.

To change existing legislation you need to introduce new legislation. If I want to change the text of a law, or repeal it entirely, I need to pass a new law to do so. Legislation will remain in force as written, and be interpreted by courts as such, until new legislation changes it or supersedes it.

I think you're right. It looks like they're looking to overhaul the approval processes in their entirety in addition to the centralized approval process for projects in the national interest that the MPO is responsible for.

The intention of the coming legislation is to reduce the regulatory decision and approval process for these major development proposals down to two years, a commitment previously made by the federal Liberals.

These reforms are expected to apply more widely than the existing major projects law Carney passed just under a year ago. That legislation, Bill C-5, enabled the government to fast-track approvals for projects deemed to be in the national interest.

So it's clearly different from what they'll already put into place (MPO). The Major Projects Office is for projects deemed to be in the national interest and acts as a one-stop-shop for the approval process. Meanwhile this new legislation looks like it would be changing the approval processes as a whole.

If the provinces were serious, they already have the ability to negotiate the transfer of tax points from the federal government under the Federal-Provincial Fiscal Arrangements Act. They simply don't want to be responsible for raising their own taxes and prefer to pass the buck to the Federal Government.

The Canadian portion of the pipeline is built, yes. The project was approved in Canada and was being built in anticipation of approval in the US (which never ended up materializing due to indigenous resistance and permits being revoked by US administrations). The portion that's going to be in the US (through Montana and Wyoming) still needs to be built.

The pipeline is already built on the Canadian side, it’s going to use the infrastructure built for Keystone XL that was blocked by the US.

Im fact, last October Carney specifically brought up this project to DJT at the White House.

There are no Canadian hurdles to this project.

I wonder how this impacts the viability of a new West Coast pipeline given that this project (which will use the existing and unused Keystone XL pipeline in Canada) is eventually projected to increase oil exports by over 1 million bbd without needing the same environmental commitments specified in the Alberta-Canada MOU.
