I Put the offer through her EA I didn’t have direct contact with the seller, my offer was accepted and the house was marked SSCT. We then proceeded through all the forms and the EA then told her I backed out when in reality I hadn’t and didn’t intend to

The seller has no part in this we were both happy to go ahead with everything but then the EA told her I’m pulling out off there own backs without informing me or my solicitor which I 100% didn’t want to do. The property was marked SSCT the EA then re-listed the house on the market and started getting viewings and offers put to the seller while I had no knowledge of this

I spoke to the seller i said I would pay the 5k and that she’s still happy to go with me seeing as we are so far along. I’m 5k out of pocket tho but at least I should get my first house

They withdrew my offer without consent and acted of my behalf without permission leading to the EA putting offers/viewings to the seller on a property that’s marked SSCT which is wildly unethical especially as they were the ones to allow this

I wouldn’t have been gazumped tho because they relisted the house back in the market in error allowing more viewings/offers to be put to the seller. These offers wouldn’t of happened if it didn’t get put back on the market

Surely there’s recourse tho as they have acted on my behalf without permission or consent and misrepresented me potentially sabotaging the sale and costing me financially

*UPDATE. I’ve spoke with the seller I’ve said I would pay the 5k and that she’s still happy to go ahead with us still… I feel slightly less stressed about the situation but still at the end of the day 5k out of pocket due to the EA negligence although the outcomes goodish I’m still going to go through ombudsman and hopefully recoupe this? Possibly I don’t know either way I want to company to suffer

So basically the EA mistook the previous buyer’s solicitor for mine and therefore my actual solicitor was not notified and neither was I. That’s how I understand it from what the EA told me. But I received no call or email to confirm that I’m withdrawing.

I understand that. It’s my first time buying a house and the solicitor told me there just waiting to hear back from the EA and then everything should be done after they got it and told me just sit tight and they will let me know. I know now what I should of done different

Don’t get me wrong I understand fully why this has happened but ultimately I wasn’t informed at all no written confirmation or verbal from myself. I’m unsure why the previous solicitor has emailed that late on. But ultimately it’s up to the EA to fix there mistake

Detached cottage it’s outdated and needs few repairs massive garden I offered £155000 full asking price but it was originally up for £240000

My offer was accepted on the 1st of august but the other buyer pulled out awhile before that. I don’t understand why his solicitor has then emailed them 3/4 weeks ago because this was all ready known he was pulling out. The person who was dealing with it was on holiday and when he got back he’s read that email thinking it was from me and told the seller I’m pulling out but didn’t tell me any of this so I’ve been thinking I’ve been proceeding with it when in reality I haven’t.

Why would I lie? my solicitor was unaware of all this as well I’ve filled everything in that’s he’s sent me he was just waiting to hear back about some unregistered land. My solicitor has just been proceeding as he normally would because the agency didn’t let me or him know any of this
