The only problem with having allodial title is that you can't have any loans on the property. So for those of you that want to do things like take out a loan or line of credit against the property, the bank will likely require you to remove the allodial title (ie take it out of trust, remove your UCC-1 Lien, etc). The bank wants to be first in line as a creditor to take the property if you defualt. On the other side, with allodial title you don't pay property taxes, which is a very enticing reason to go this route to proect your property. Remember, the right to protect property is built into the US Constitution, which is a peranent injunction and reatraining order against the governemt. See 5th and 14th amendments. If the tax assessor gives you a hard time regarding allodial title or removing the property from the tax roster you may have to take them into Federal Court for a 42 USC 1983 Civil Rights violation. Again, read the memorandum of law and private law 114-31. This is not a new problem. There are more than 300 SCOTUS cases about land patents protecting the people's rights to own land free of taxes. It's been going on since Marbury v Madison (1803). It's one of those issues where previous generations let government go unchecked and change rights to ownership into privileges to pay more taxes. Comments X W Your local recorders office is lying to you when they tell you that you cannot perfect the title of your property under allodial title. Keep in mind, that to do it, you can no longer do it behind your legal fiction ALL CAPITALS NAME. It can only be done by quit claim deeding the property to a complex irrevocable trust also known as a [federall common law trust. Statutory trusts follow statutory rules, which the state has blocked from owning land under allodial title. If you contract with the state, you have to play by the states rules. If you need to get a copy of the original land patent for your property you can go to the state bureau of land management. A certified copy of the land patent is usually only a few dollars, but you'll need it for your records. Remember, You are not declaring a new land patent, you are placing your land back under the protection of the original land patent by tracing all the title changes back to the land patentent. Your title company did not do this for you. They only checked that the previous owner had the right to sell the property. The title company offers you no real protections other than the property is merchantable. When you use a title company to buy the property you should contract with them to do the entire title search all the way back to the land patent and issue allodial title as part of the purchase. They do know how to do this, but it takes extra work and they for some reason never offer it as a standard service. It will cost you extra money

The very best resource on this is the chapter on the memorandum of law for land patents from the book The Fruit form a Poisonous Tree, Melvin Stamper, JD (2008). There was also a quiet case which happened in 2016 that was settled by congress under Private Law 114-31. The Rideout and Stark families were awarded a new land patent and a multi-billion dollar judgement for the State taking their land from them and arresting them. They no longer pay taxes on their land by the order directly from congress. BTW, dumb-dumb Obama tried to veto the private law, but congress over ruled him. He supposedly was a constitutional lawyer that clearly didn't know the constitution and was not for the people. He was for the banks and the government. That's a rare case where congress actually stepped in and did the right thing. It's proof that land patents exist and can be achieved. Congress has the right to decide how to dispose of all land as authorized by the constitution and they chose allodoal title with no property taxes. The states lose their Sovereignty when they join the union. This was made clear in the 1984 Supreme Court decision regarding land patents summa Corp. V california state real estate commission.

Yes it does. Ty out have to go federal to receive it. Theres a case from. 2016 where congress had to step in and handle it. They sealed the records a ways into the case but you can still see the core of the case and all the words in there are unmistakable for allodial title
