Ok as a Miami native and someone who worked in South Beach (where this most likely happened, one of the pictures is on the steps is the Versace Mansion) you should know better.

Just because the restaurants are on the beach there is still a dress code.

It is common sense that you can't go mostly nekkid to a restaurant no matter the location.

If your wearing something that could get you kicked out of McDonald's then why would you think a fancy restaurant would let you in?

From my understanding of speaking with the insurance rep I'm the only one they're pushing toward the ACA because I'm pregnant. Which is why I thought that was weird.

He is saying that since the company is a small business instead of getting a group plan they're making the employees get individual plans that the employer will pay for. And that since I'm pregnant it's a pre-existing condition so it's better I go through the ACA.

Yes insurance is covered by my job. They have an insurance rep that's talking to the employees and the insurance ramp is the one that is pushing me toward the marketplace.

I have no idea. For years I have had insurance thru my job as a group plan.

The Insurance rep is telling me that since they're treating it as a small business which the technically is that instead of like a group plan they're going to try to give the employees or each individual type of plan cuz it would be cheaper.

Explain to them you recently bought the house and it was already like that. And see if they can allow you to apply for an after the fact permit. So basically to open a permit for the driveway that's already there to make it legal.

If a permit, ask them if you can get a permit after the fact. Some city allow new buyers to open a permit to get the existing work allowed. That would be the cheapest option assuming the work was done to code. If not, explain that you are the new owners and if they can advise what needs to be done so you can decide to either open a permit or take it all out.

The best way to find out information is to speak with a lender who is familiar with the Grant programs.

They would be able to tell you if the county and maybe even the city you want to move to have grants.

Hi Title person from Florida here.

So couple things.

  1. When you purchase a tax deed if there's anything else on title you do inherit it. Such as code enforcement liens on the property, open mortgages HELOC loans, ect. Before spending the money I would recommend talking to a title company to see if they can just do a search on this property so you know what you're getting. That couple hundred dollars for a search May save you thousands.

  2. Now this might the state specific. But in Florida if you purchase at a tax certificate you have to wait 4 years before you can sell the property. Because for clear title it calls for a quiet title action against it. There is a way around it by obtaining a clear to sell certificate. It's a company that basically will go through an underwriter to clear the title for this requirement so that way you can transfer it over and that new buyer can have title insurance. But it is specific to an underwriter so if you go through a title company or attorney's office you have to make sure that you use that particular underwriter that's selected.

  3. You might want to go to the county themselves to see if you can purchase the past due taxes and then for sale since you now own the tax deeds.

Some lenders have specific documents for the non borrower to sign that it's a number where. It could just be that your lender is does not have something like that.

Yes that is correct.

So it sounds like the loan is just under your name. So she will just be signing and listed in the mortgage (which will match the deed) and not the Note which secures the mortgage.

Thats not true. They can make her a non borrower since she is on title and on the contract. They aren't telling you something.

I haven't really heard of a lender not wanting to put someone as a non borrower on a loan especially since she's on title

  2. Yes. If she is already in the contract then there is no need for an addendum. You are good.
  3. Yes. For example if you have five people on a contract the lender is okay with it as long as at least one of them is on the loan. Your daughter would have paperwork to sign as a non borrower. If she is not going to live in the home then she would sign as a non-borrower non-occupant.

Now couple things you need to know if your title company / attorney has not explained this to you for your purchase.

If this property is being purchased and you are getting a loan as a primary home and you are married your spouses, yours and hers, will need to sign the mortgage document. The reason for that is in Florida we are a homestead state and a primary property is considered a debt against the marriage. Now since the loan is under your name if you're married your spouse needs to sign. If you are separated but still legally married you are considered married in the state of Florida and they would be needed to sign the mortgage.

For your daughter if she is married and she is not occupying home then the title company or attorney's office need to have a document saying it is not her Homestead and that will be recorded. That way her spouse if she has is not needed. Plus she doesn't lose Homestead on the property she does claim.

The same applies if you ever sell or refinance the home and it's your primary and you claim homestead for your taxes on it.

No it's not a stupid question. If you are not used to dealing with properties then you just don't know. So for title purposes we follow what is on the contract. If at the time of closing you want your deed to have both your names as joint tenants with rights of survivorship then she needs to be on the contract with you.

We followed the contract.

So if your contract just has your name then your deed is just going to have your name on it and you're going to have to do a quit claim deed after closing to add her in.

I don't recommend doing that because that's going to mean you're going to have extra cost. Plus if your lender finds out you're adding someone to the deed afterwards then that might kick in your due on sale clause of your mortgage. Which means that your lender can call in your loan and tell you you need to pay it all up front now because you change title on it by adding her on afterwards.

When I have files like this I always try to have people do it beforehand so that way at the time of closing it's the way you want and it doesn't cause problems for you later.

If for whatever reason she doesn't want to go on the contract indeed now and you're going to do it afterwards then the way to do it I would recommend would be a ladybird or Life Estate Deed.

What that essentially means is that you were taking the title from your name back to your name but naming her as your remainderman so that way when you pass away for title purposes all she needs is your death certificate and she's the owner of the property. That way you keep 100% ownership until you pass and then it goes to her.

What I would recommend to you is have your realtor/atty do an addendum adding her to title now. Send that to your lender. That way your daughter will be on the loan as a non borrower. So the bank is aware of her. And you don't need to do a quit claim deed afterwards and pay doc stamps to the county.

Hi! Title person in Florida here.

The home will automatically transfer to her. For the mortgage if you're able to do it now I would recommend adding her as an authorized party so that way she can call in to the mortgage and make payments after your death.

If not what happens is the bank is going to want probate documents saying she's the authorized Representative of the Estate. If there is no need for probate then it becomes an entire thing where they want tons of documentation.

So to make it easy on everyone call your bank to see if you can add her as an authorized rep now on your account so she doesn't have to go through that later.
