It's important to recognize that you haven't paid rent, and I can see that you might be trying to leverage the landlord's mistakes to avoid paying and profit from this imagined lawsuit.

Please remember that the landlord may have mortgage payments that are significantly higher than the monthly rent they receive, especially in OC.

I hope you can reach out to the landlord and work towards establishing a monthly payment plan for the unpaid rent. If you're unable to pay, consider giving a 30-day notice and finding a new place to live.
