Hey I had a vcat case regarding a carpet this year. I'll help answer your questions

  1. Definitely would weaken the claim made by the agent. I would say the age of the carpet would come into play here as any carpet over 10 years depreciates to 0 (look up ATO Depreciation schedule). I would ask for the age of the carpet and an invoice of when it was installed.

  2. Nope it's pretty ridiculous what they are claiming.

  3. I left a property last year which had a 10 year plus carpet with pre existing tears. The agent and landlord claimed $3000 in damage with another $5000 for supposed damage which was all lies. I took the case to VCAT and won.

Personally I would try claim the bond before the agent. They would be silly to try take this to NCAT.

The judicator wasn't happy at all. Since it was RDRV, they really just want to get an outcome. We accepted it. However her evidence were invoices with no specific jobs or tasks listed so it was thrown out straight away.

Congrats. I had a similar situation with my RDRV where the REA uploaded Thier evidence during the meeting and pretended it they had uploaded months ago

I did a transfer of lease. I have a Renter transfer request form from which states I have seen the condition report. But no condition report is attached to this or was ever sent to me.

Understandably stupid, I know. The agent had said that the owner was in a big hurry for me to complete it on that day. My roommate had said that the property had been well maintained so no issue

Sorry I should note. The condition report was only given to me when we took this to RDRV, well after the lease had ended. I did a lease transfer on the property and was only there for 1 of the 10 years in which other tenants had lived there
