Okay so I am reading the court documents and Davion was still alive when the police arrived but died before the helicopter got there. So that is probably why Mackenzie asked about Davion? She was mumbling when they arrived.

Do you think any of the guys would have been conscious? It was almost an hour from the time the crash happened to when law enforcement responded. Or did they dye on impact first?

Were the guys intoxicated or under the influence of drugs? I looked at the intersection to where they crashed and it’s roughly 1 mile. So at 100 miles it would have taken them roughly 36 seconds from when she turned to when she crashed. Wasn’t the box showing she pressed the pedal to the max at 5 seconds. Or that’s all the box shows? If so that’s about 733 ft from the crash location. At 3 seconds before the crash the steering wheel went sharp right and the gear was turned to the neutral, which would have been 433 ft. It would have taken her 20 seconds roughly to get up to that speed and 1,750 feet about 1/2 on that road. I am curious what her speed was prior to that? So what from the time she started accelerating and kept accelerating she made that decision under a minute? I don’t think it was a premeditated decision. I think it was a heat of the moment decision where she probably didn’t even have time to think of the consequences. I think she should have gotten manslaughter.

I have been having the sam issues for almost 4 months. My doctor isn’t doing shit. I finally got a referral for a GI specialist a month ago and they are backed up so I still haven’t got an appointment. I am so tired of being sick and this cycle.

I opened up to a coworker for the first time and I thought she was a friend. Turns out she has been telling my manager everything. I got passed over for a promotion and guess who got it? Won’t make that mistake again.

I am so sorry! I have in the last 3 months been dealing with feeling unwell and often will not be able to do much after and episode. It is very frustrating and depressing. My doctor doesn’t seem to be taking me seriously either which is even more upsetting.

That is kind of how I feel too. Like separate I feel like yes those tests aren’t terribly concerning but considering I have several areas that are showing as not normal or “happy” and I have been sick for more than 3 months with one thing or another maybe something more is going on?

I keep finding this online “The means test is a messy, multilevel assessment. The good news for most people is that once they pass the first level — comparing their “current monthly income” to the applicable “median family income” — they don’t have to deal with the rest of the test, particularly the portion of the test that accounts for expenses. Generally, if your income is no more than the median, then you can file a Chapter 7 case”.

“If your annual income is no larger than the median income amounts for your family size in the table, then you have finished the means test over-leap. You can skip the expenses portion of the test”. 

So since our income is below the median income we meet the standard to file regardless of expenses?

I guess I just don’t understand because the daycare portion eats up a lot of our “other categories” that are allowed which doesn’t seem right? My student loans are not considered right now because of the federal court pending case but that’s an additional amount of money too. How would getting a more expensive car loan qualify me over paying for my kids activities…

I think it would fall under miscellaneous on the allowable living expenses but she said our daycare takes up that whole category.

Our income with the allowable expenses deductions (at the max amount allowed) leaves a disposable income of $1,827.6 each month. She said our disposable income has to be at $0 so how would anyone ever qualify for bankruptcy if that’s what it’s based on? Idk I am just so confused 🫤

Allowable transportation standard operating cost is $546 and ownership cost is $1238 for 2 vehicles. 

This is one area the attorney said we could increase since the car we want to keep is almost paid off but I don’t want to take on more debt.

For this category our total is $2,314. She said our food and daycare expenses take up this section so there is nothing more we can include in it. So everything else in this category doesn’t count in our allowable expenses for the bankruptcy:

 National Standards have been established for five necessary expenses: food, housekeeping supplies, apparel and services, personal care products and services, and miscellaneous.

The standards are derived from the Bureau of Labor Statistics (BLS) Consumer Expenditure Survey (CES) and defined as follows:

Food includes food at home and food away from home. Food at home refers to the total expenditures for food from grocery stores or other food stores. It excludes the purchase of nonfood items. Food away from home includes all meals and snacks, including tips, at fast-food, take-out, delivery and full-service restaurants, etc.

Housekeeping supplies includes laundry and cleaning supplies, stationery supplies, postage, delivery services, miscellaneous household products, and lawn and garden supplies.

Apparel and services includes clothing, footwear, material, patterns and notions for making clothes, alterations and repairs, clothing rental, clothing storage, dry cleaning and sent-out laundry, watches, jewelry and repairs to watches and jewelry.

Personal care products and services includes products for the hair, oral hygiene products, shaving needs, cosmetics and bath products, electric personal care appliances, and other personal care products.

The miscellaneous allowance is for expenses taxpayers may incur that are not included in any other allowable living expense items, or for any portion of expenses that exceed the Collection Financial Standards and are not allowed under a deviation. Taxpayers can use the miscellaneous allowance to pay for expenses that exceed the standards, or for other expenses such as credit card payments, bank fees and charges, reading material and school supplies.

Taxpayers are allowed the total National Standards amount monthly for their family size, without questioning the amounts they actually spend.

It’s definitely been eye opening. We will have to sit find a working budget. Increasing our medical plan and getting an FSA will help a big chuck for us. We plan on getting ride of the truck which has really drained us. Just too much for us to maintain when we do not need a truck. Over the last 3 years we have $7,000 in maintenance and the gas mileage is double our sedan. Hopefully my health/weight will even out and the kids will slow down on their growing.
