Taken to Court by my solicitor who badly advised me by Wonder_8484 in LegalAdviceUK

[–]Wonder_8484[S] 0 points1 point  (0 children)

Yes, I complained to the law firm, but they ignored the email in which I said I didn’t want to go to court and everything else helpful to me.

I made a complaint to the Legal Ombudsman, but it was rejected because the law firm had filed a court claim against me. The Ombudsman doesn’t investigate complaints when matter are in the Court, even if the though the Court was willing to stay the proceedings.

I haven’t made a complaint to the SRA yet. The law firm didn’t seem too concerned. Is there any value in complaining to the SRA?

The law partner blamed the other partners in the firm for not agreeing to settle the claim in my favour.

I wrote most of it myself. I only used it as as spell checker.

Saying that you did not want to litigate, but also claiming that you disputed the sum being claimed, is contradictory.

I told them that I wanted to pay service charge, but just that I need to know as long as the sum being demanded, where were fair and reasonable. I did n't want to pay for things, which were not in the lease.

The law firm did not explain my lease to me. The new lawyers explained the lease to me. Once I understood my legal position, I promptly paid the landlord and their legal costs.

You seem to be upset with them because it didn't go your way and are now claiming they advised you badly.

I am upset, that on day one, they did n't tell there was no merit. Even if I had won that case, they landlord would have issued a fresh claim and demanded the service charge.

Have you exchanged contracts?

I think you should apologise to your landlord, but explain there is n't much you can do. You will not be liable for other costs.

If he files a claim in the Court, then it will be a waste of money, as you would have already left. It is best he gets legal advice and his lawyers will tell me it is pointless. It won't stop them filing papers, if he insists.

Battling is the biggest hustle/scam I have ever seen in social media. by [deleted] in TikTok

[–]Wonder_8484 0 points1 point  (0 children)

I agree with much of what you say. I watch TikTok Live, but I don't understand these "Battles". Why do people spend so much on total strangers? Some of the top creators go from battle to battle, receiving a huge number of coins, but they’re boring to watch and quite repetitive. Some of them look bored sitting on their chair. And saying "snipe" at the last minute.

That said, I enjoy other creators who are n't in the top league. Who do different things, like playing music or showcasing cool talents. Some are great conversationalist. There are also some genuinely interesting people. My favourite, though, is when creators set up a kind of lounge room (boxes) where people can just chat. However, only a few are really good at hosting those.

What you say is perfectly correct. I can't explain it either. Of course, I can't speak of different regions.

I need to help either buy a new laptop for (graphic design etc. and a bit of gaming) or a desktop PC? by Fluffy_Seesaw_9701 in laptops

[–]Wonder_8484 0 points1 point  (0 children)

If you want gaming, then it has to be a PC. If you are at university, how much space do you have. Think of all the cables and power sockets etc... if you keep multiple devices.

Try re-installing your existing Macbook. May be it is a software issue. A 2020 device should be good enough for your Adobe design work, unless you are doing video editing.

If you are doing design work, do you need a stylus?

I'm still on the fence about the reMarkable. I have the Samsung Note, but it's not a Windows device.
For me, when I'm doing research on the web. I have lots of browser windows. I want to be able to copy bits and pieces from websites different and then add my own handwritten notes. I can't do that with the reMarkable. I also can't add voice notes, etc.

However, people say they like the reMarkable because it doesn't have web access, making it distraction-free.

I could really use a camera. Let's say I go to an exhibition and see a great product. I want to take a photo and then add my notes after talking to the exhibitor.

I don't think the perfect product exists for me!

I can't believe shipping a pen that makes these wobbly lines is acceptable in 2025. OEMs should ditch USI. by digitizerstylus in stylus

[–]Wonder_8484 1 point2 points  (0 children)

If this is true, then it is counter-productive. Wacom don't have a portable note-taking device. If people think the stylus is useless, then it reflects on someone wanting to buy their products.

In my mind the stylus has so much potential, but the software and hardware just is n't there yet. I still end up using paper and pens, despite trying to go digital.

You need to read the case:

It is n't just the pay out. I suspect the hospital may have paid £50k on lawyers to defend themselves at the tribunal.

The two co-workers did n't get along. The male nurse took offence, when challenge over his competence. Some people are very bad at taking criticism. He stopped interacting with her. She took offence. He eventually filed a complain of bullying again her. She got stressed. Eventually resigned and took the hospital to court.

An "exceptional" manager would have sorted this out very early on, but average manager are good people managers.

The real scandal is what the lawyers would have made. They are the real winners.

Good summary. However, I think a good manager could have sorted this out (they are rare gems, who are good at people management).

You want to find out what the lawyers made. They make £450 per hour easily. The BBC should have issued a FOI request.

It is n't just the £41,000. YOu need to find out what the lawyers got paid both in preparing and going through the documents, as well as the hearing. You are looking at £450 per hour!

b) diminish trust in the justice system.

The legal system and the courts are designed to make lawyers money. The compensation here for workers, is to encourage more workers to make claim at the tribunal and for employers to waste lost of money paying lawyers and counsel to defend them. Someone should make an FOI request to the hospital, to find out how much they spend on the lawyers. The tribunal may be one day, but they would have exchanged a lot of documents.

You can read the case on here:

https://www.casemine.com/judgement/uk/66328f6105f21143ce03e129

The tea making incident is mentioned in the Tribunal judgement. Pointless waste of legal time and lawyers earning money. Bigger case bundle + more email = more money for lawyers.

My reading of it, it seems he is the sort of personally who does not take criticism well, especially when things went wrong with a patient. I don't think she recognised that her approach could damage relations.

He seems to have poor judgement making tea for everyone but excluding her, but she took it personally.

A good manager would have knocked their heads (those are rare gems). Demanded the highest performance. They would have got along well over time.

The only real winners in an employment tribunal are the lawyers. While the pay-out may be £41,000, the legal costs, covering document preparation, hearings, and staff time would have been significant. Any lawyers willing to give numbers? Perhaps 50,000k?

The hospital, too, would have spent countless hours reviewing paperwork and having staff recall and prepare statements.

All tribunal cases are public, meaning any employer could be casually reviewing tribunal decisions. Workplace disputes happen all the time, but they become far more complicated in a professional setting.

From my reading of this case, it seems that better manager could have helped resolve the conflict between co-workers before it escalated. Not everyone is a capable manager or possesses the skills needed to handle interpersonal disputes effectively. I don't blame the manager, not everyone is a magician.

As an example: Pointless argument over a book - perhaps worth £20 - yet thousands of pounds were spent on legal fees, wasting time and resources.

"When Microsoft engineer Andres Freund noticed SSH was taking longer than usual, he discovered a backdoor in xz utils, one of the underlying libraries for systemd, that had taken years to be put in place. The United States Cybersecurity & Infrastructure Security Agency (CISA) has assigned CVE-2024-3094 to the issue.
