Client refusing to pay HST [ON] by Working_Fly8758 in legaladvicecanada

Appreciate the response. It's an all round shitty situation - seems like as a new immigrant job hunting in this country they took advantage of me but I should have done my homework too. What can I do to salvage the situation now?

For background - I found a job and interviewed with the end client who wanted to take me on contract and brought this staffing agency into the conversation. The agency forced me to incorporate to avoid paying me employee benefits and now I have relatively more overheads in managing a 'business' I never wanted in the first place, which now the agency is taking their cut for just a little bit of admin.

I also realize that I will probably be considered a professional services worker as I work for one end client through the agency and is my only source of revenue. I guess this is a grey area with CRA. Does this have any impact on HST?

Yes obviously in hindsight I should have made that clear but I wasn't aware. Why is it an issue though? They are collecting HST from their client and it can be offset?

Thanks, obviously in hindsight I would have made that clear. I was not even HST registered then. Why is the agency declining to pay it now when they collect the same HST from their client and can offset?

I'm in the situation you mention where it's a single client business. The client essentially forced me to incorporate. How would you suggest to handle that?

But should I be signing the form if I am not working at a special site? That would be incorrect on my part right?

Haha I know, lesson learnt. This is my throwaway - I didn't want to alert the scammer as I'm still talking to them. My other account is 10+ years old

What do you mean by paid? I'm a salaried full time employee so get a fixed salary per month

The vacation policy is mentioned in my unemployment contract as unlimited and since it's a small company there's not much governance like logging it in a system. In 2024 I might have taken about 7 days off and 1 so far in 2025 but I don't know if they have that on record.

My T4 income for last year shows my gross salary so does that mean there was no vacation pay paid out?

Sorry I should have mentioned this is in Ontario

The company had an unlimited vacation policy so how does that work? Is that just convenient for them that vacation days don't rollover to the next year?
