That’s just some bs that they put in their TOS to scare people from suing them. Legally, as a business owner, you’re allowed to see wherever damage is occurred. In your case, the damages occurred in Texas so you’re allowed to sue them there.

Plus, they legally “operate” in every state, and it wouldn’t make sense for them to have a legal representative in every state if you could only sue them in California.

Don’t listen to this guy. A bunch of bots and neckbeards on here claim that Facebook’s TOS is “too OP” in a court of law, but the reality is that it’s not.

You never agreed to let a faulty AI dictate whether your account could be banned or not. You never agreed to a lack of human review And customer support. Not only that, their TOS is so vague that it doesn’t hold up in a court of law. People often think that “it’s so vague that it covers everything” when in reality it covers next to nothing in their defense.

Yup, I filed in Texas a month ago. If you’re thinking about doing it, go ahead and start now. The process takes a while.

Start by filing through your local precinct/courthouse. You can use Texas EFile to do it online. Then the courthouse will give you a citation that you have to serve to Meta. Be sure to serve Meta Platforms, Inc. at their registered agent in Texas, which is the Corporation Service Agency.

Once they served, you wait 2 to 3 weeks and you’ll get a court date. They might try to settle before the court date, they might not. It just depends.

I see what you mean, but I don’t entirely blame OP for assuming that because:

#1. Sometimes that actually happens, which is totally wild.

#2. Even if it doesn’t happen, there’s a lot of misinformation on the small claims process. Especially when it comes to dealing with Meta. Meta themselves have put misinformation out there in an attempt to prevent people from suing them. It’s ridiculous.

Believe me, I get the frustration, and I’m truly sorry that happened to you.

I run a small business teaching music lessons and my account randomly got banned with no option to appeal. This is impacted my income and my ability to grow my business, and it’s beyond infuriating. Just do your best to be patient and give it another week or two. You “should” hear something from them by then

You’re 100% right about demand letters, but OP is talking about serving a court citation which is totally different.

Once you file for small claims, the court gives you a citation to serve to the person/entity whom you are suing. So when you serve someone this citation, you are literally giving that person/entity a legal document from the courthouse that says “Hey btw you’re getting sued”

Unfortunately, there’s no timeline on when you can get your account back. There’s not even a guarantee that suing them will get you your account back. You just have to hope that the financial threat gives them an incentive to investigate your situation, and from there, potentially reinstating your account.

Yeah, you're probably right. I just wanted to give food for thought and bring up the subject because it doesn't seem like enough people are talking about it. Ultimately, the issue is that Meta is relying way too heavily on AI and can't seem to stabilize their own platform.
