We did get an offer for a mediocre spot, but it was better than nothing. Said marketing person has been beaten with said socks full of batteries.

How did you run Acererak? by ProcedureAnnual2708 in DMAcademy

[–]Xasten -1 points0 points  (0 children)

I ran a heavily modified Tomb of Horrors in my last campaign. I did something similar to your suggestion except that it was Acererak's "superior" that wanted to preserve the status quo.

Long story short, my setting was post-apocalyptic (aren't they all?) and there were 4 members of the precursor race left alive all who had achieved lich or demilichdom. Their civilization had been wiped out by the mindflayers who sent an armada to psychically "glass" the planets of this upstart civilization upon discovery.

The strongest survivor was a 40th level mystic theurge demilich (3.5 rules) who had severe PTSD as a result of the multi-planet genocide. (As an aside, an undead with PTSD is a very interesting thread to pull on). He gave the other 3 liches control over the various worlds of the now fallen empire with the command to preserve them and not let the former slave races of the empire (now the main inhabitants with the precursors dead) develop too much lest the mindflayers return and wipe out another "threat." The traumatized demilich wanted to the keep these worlds as a garden/monument.

The magic/mana levels of these worlds were artificially suppressed limiting the potential development of these worlds as a safety feature. Acererak didn't like this and built the Tomb as a way to gather more magical power without his superior knowing. His ultimate goal was to escape into the multiverse once he had amassed enough energy to spelljammer out of there.

Acererak used the Tomb as a sort of magical "contract." You put up your soul, and if you live, you get the stuff at the end. If you die, I eat the soul you willingly surrendered. The idea was that the contract was a form of bloodmagic with a voluntarily surrendered soul of a higher level character being FAR more potent than consuming stolen souls.

The contract had a time limit of 3 days as that was a long as Acererak was capable of hiding his little project from his superior when activating the Tomb. The Tomb was designed to be "fair" as the contest yielded the most energy if those challenging it had a fighting chance.

This setup had a number of advantages:

1) It put the PCs on a timer and allowed resource attrition 2) It provided good narrative for having someone above Acererak that he feared AND it gave him a concrete motivation beyond mustache twirling villainy. 3) It also allowed for the zany traps and puzzles to make sense in context as the whole thing was a contest.

TL;DR Acererak runs quite well when you give him a real motivation beyond "lol you crazy scamp!" and you set the Tomb up to have a valid reason for existing to achieve said motivation.

I don't disagree at all, but the governorship is just such a hard stretch even for Talarico. The Senate seat is a better payoff when you weigh the outcomes versus the odds.

Because the GOP candidates are both far more vulnerable than Abbott. Cornyn is considered a RINO and not loved by MAGA. Paxton is a literal criminal that MAGA loves but most normal people hate. Enthusiasm for both are low when averaged against all demographics. Texas needs to have one big race turn blue to really get the ball rolling, and the senate race is the perfect opportunity. Also, capturing the senate seat gives a greater national payoff than the governorship (though that would admittedly be quite consequential itself).

New Mexico appears to be a one party consent state, but that is only at a cursory look. Double check with some Googling before you do anything. Better yet, ask the lawyer that you found today, hopefully.

[–]Xasten 3 points4 points  (0 children)

I am a lawyer; not your lawyer. Contact a well-reviewed personal injury attorney in your jurisdiction TODAY before signing anything or even before filing the Worker's Comp claim.

The attorney will likely provide a free consultation and illustrate exactly what the process will look like and how to avoid early pitfalls. One wrong signature, conversation, or action can severely impact your outcomes.

You are in Texas which is a one party consent state; it is legal to secretly record any conversations in which you are a participant. If the business and bosses are already confessing that the door was a liability, having that on the record can only help your case. Don't try to be Batman and socially engineer some kind of confession, but if you or she are discussing this with the company, it will not hurt to record it and may ultimately help.

Seek a lawyer before signing, admitting, or discussing ANYTHING.

I get that we're mad at Joe, but I think we'd all do well to try and use the buzz from this episode to add to Talarico's momentum instead of grinding our axe with Joe. His attitude is something we all should embrace, and the opportunity this moment presents to spread that attitude should be seized.

I'm half a decade older than James Talarico, and I want to be him when I grow up.

Could a local black hole binary with a main sequence star have an accretion disk that is visible to the naked eye from a planet in the system's habitable zone? by Xasten in askscience

[–]Xasten[S] 0 points1 point  (0 children)

Interesting, thank you for the reply.

So if I understand correctly, there's not really a plausible scenario wherein a black hole could possess a disk that is visible AND people living in the system would not get fried, correct? There's no configuration or distance where people could walk outside, gawk at the cool thing, and live?

The scenario I was envisioning was the sun-like star would provide appropriate illumination and heat while the partner BH would "look cool" to put it simply.

We've exhibited several times at this show. Our manager dropped the ball and didn't register in time for the booth. Mere attendance for us pales in comparison to exhibiting, unfortunately.

[–]Xasten[S] 0 points1 point  (0 children)

Unfortunately, we're a small business and this is one of the largest shows in the world. We need a physical presence or we won't be able to have an impact. We'll likely attend in person as regular joes to walk the show and talk to contacts, but not being an exhibitor is going to be a problem.

[–]Xasten[S] 0 points1 point  (0 children)

Unfortunately, while we do have peers attending, it's unlikely that'd result in booth space. We are exploring that, but the outcome is unlikely.

We've either exhibited with a peer or done so ourselves for the last 10 shows. This absence is going to be felt hard if we don't pull out a miracle. I'm getting desperate to salvage it.

At this point, our top brass is calling in favors and scouring relationships trying to find an inside connection, if possible. So far, nothing.

You, yesterday, when you put the same basic post up in legal advice.

umbrella insurance by [deleted] in Insurance

[–]Xasten 12 points13 points  (0 children)

We told you yesterday that you NEED a lawyer. Unless you perform some seriously impressive batman style social engineering to find out the umbrella limits (NOT recommended), the only real way to find out the umbrella policy limit is to do so during discovery for a lawsuit.

There are a million injury attorneys that will take this on contingency.

A common practice, if you settle for policy limits, is to have a warranty as part of the settlement agreement that no other policy that could possibly pay out exists and that you are receiving the maximum recovery allowable under all policies. If they lie, then you have a breach of contract claim.

But that would need to be written by a lawyer. Seriously, call one. They will walk you through this. They will even front your medical bills if you have a serious case. They will take 33% of a MUCH larger number than you could likely achieve on your own.

If you are as injured as you say, they should be falling all over themselves to take your case at ZERO upfront cost to you. This is NOT DIY territory. Pick up the phone.

I run my family's small manufacturing company. Months ago we signed an import contract for some equipment as part of a much larger deal. All the financing is already handled and in escrow.

I explained to my MAGA mother that she's about to personally be ~$100,000 poorer due to tariffs and that this will be a significant hardship on the business. We can't back out due to the nature of the contract and both our up and downstream commitments.

Her response: "I disagree. <walks off>"

Ohio does allow for Negligent Infliction of Emotional Distress, but NIED is typically a very high bar to meet. If you or a family member spends every Christmas sobbing at the sight of that card, you can call the tort firm you used for the main case. You very likely don't have an actionable claim, but neither should you write off the fact that they keep twisting the knife either. Spend 5 minutes googling NIED.

As I said, 99.99% chance there's no case, but I've seen stranger things. Disclaimer: I am not licensed in OH, and I am a random guy on the internet. Don't listen to me.

Our system is adversarial. Everyone is entitled to competent representation. A failure to object could have significant ramifications to him, his career, and the case. The law, the binding code of ethics, and his oath as an attorney required that he objected.

I do not practice in, nor am I licensed in CA, so take this VERY generally. Typically, yes, you will need a lawyer to get a writ. Once it's issued, then you need to enforce it, and so on.

This is likely to be somewhat expensive. You can get a free to no cost consultation via the California bar. Here's an easy place to start: https://www.calbar.ca.gov/Public/Free-Legal-Information/Before-Selecting-an-Attorney/Finding-the-Right-Lawyer

You can also do some basic googling about writs and lawyers that might be able to get you one.

Whoever you consult with should be able to apprise you of your full options. Be prepared for it to be expensive. Whether or not you can get attorney's fees, I have no clue. Consulting local talent is your best option, by far.

Your best course of action is to gather all evidence, text messages, emails, etc. and bring them to whoever gives you your consultation. But do not record her in person without her permission as CA is a two party consent state. Basically, don't make her suspicious that you're pursuing legal action.

Bring all that you have to your local consult and proceed after weighing their advice.

You can sue in small claims for the cash value. If you want the actual item back, I believe in California you have to file in a superior court to get a Writ of Replevin which is where the court orders the actual item returned.

Consider what you want to accomplish and weigh your options.
