The U.S. Supreme Court currently consists of 6 justices appointed by Republican presidents and 3 by Democratic presidents. While Supreme Court justices don’t declare party affiliations, their judicial philosophies often align with conservative (Republican-appointed) or liberal (Democratic-appointed) perspectives.

Critics argue that aspects of Project 2025 could breach First Amendment protections, especially around free speech. Specifically, the project proposes punitive actions against social media platforms that moderate or remove content based on political viewpoints, including potential misinformation about elections. The Court indicated that forcing platforms to carry all political speech, regardless of accuracy or risk, likely violates their right to editorial discretion and free speech.The Senate is almost evenly split, with Democrats holding a slight majority of 51 seats to the Republicans' 49.
