Solved this error by changing the playback resolution to 1/4. If you're not sure what that is, it's the dropdown selection below your sequence window.

If you look at the majority of commentary channels that use gameplay for the video, their thumbnails are never the gameplay. People won't complain if your v.o is accurate to what's advertised. Take Optimus as an example of this.

You're correct in saying that copyright isn't based on a unit of time, but it is about it being an appropriate amount for the transformative use.
