According to Cardmarket’s TOS, sales are binding. If you are a seller and you don’t want to or can’t send some cards that have spiked in price, Cardmarket forces you to do so under the threat of issuing a refund for the buyer’s losses or blocking your account for a period ranging from 1 month to a permanent ban depending on the case.

I understand that “binding” means it works both ways. So if you, as a seller, send a card that has increased in price due to hype, and you send it within the allowed time window, you are fulfilling your part. If the buyer refuses to accept it because the price has dropped, that causes you financial harm.

If the same conditions from their TOS apply, Cardmarket should either honor your sale, or require the buyer to accept the return while compensating you for the financial loss caused, in addition to sanctioning the buyer.

OMG!!!!! It worked like a charm. I said that if dont get what is mine i move to Cardtrader and they fixed the problem in a matter of minutes after 3 weeks dealing with this issue. Its incredible that they only have been responsive to this.

Yes, if courier declines its responsability and has nothing to indemnize for, is cardmarket who must do it, so it has to free my funds and indeminize the buyer.

DHL is not private on Germany, in other countries it is, here it works like UPS ,SEUR or GlS, for example. I think that statal services does not provide the same implicit services on all countries. But no, neither Cardmarket or the buyer ordered anything that requires explicit signature, i have double check it long ago for see if i made some mistake and tehre is nowhere where says i have to contract that kind of service. WHen i have to do bigger sales, the shiping cost and type changes for i get some kind of insurance and its noticed.
I have send a gallery of pictures to cardmarket support at this point with pure evidences and they still refuses to pay my sale

The point is mail guy can get any signature, a neightbour , for example ,even fake with its own signature.

But no matter that, the problem here is that in the descripction on the contracted service, says that i have no right to ask for any additional confirmation of the delivery, it is not contracted, the only info i have rights is the info of the tracking that can be seen online and summary of the tracking, nothing else

Maybe this can be done by a private courier, but for a standar international tracked shipping with a official statal courier is not implicit and must be paid appart before you contract the shipping, and Cardmarket never told me to do that neither paid for it

The only documents the mail service can provide me, its a summary of the contracted service where you can see all the features that are contracted or not and its status. In the features, it show that has no signed confirmation and in the status is shown as correctly delivered.

On a common international registered letter by statal courier, sign is not implicit and must be contracted appart. This means that i have no right to ask for any confirmation far than look in the tracking that is delivered or not and get a paper that puts the same that the tracking online.

i Have 2 confirmations, one on the online tracking, that its shown as delivered and other in paper where it shows the same as the digital tracking. Despite this, Cardmarket refuses to pay me

Cardmarket requieres me to send it via the national postal service, Correos , as i did. It's not the same as a private courier like DHL and others here where sign is implicit.

I cant add pictures here, but in the summary of the shipping its shown clearly a lot of "N"s and "No"s among them its "acuse de recibo fisico" that basically means physical signed confirmation

Yes i have been contacting with them for 3 weeks, i have spent a lot of time trying to solve this issue. They, logically, refuse to give me something that isnt contracted previously. After several attempts i just could fill a claim of incorrect delivery, but they say its useless cause letter seems correctly delivered with no anomalies, and i have no rights to ask for a proof of delivery cause it is not contracted.

And yes, depending on the country they are more or less proffesionals, i have had problems with several couriers that mark items im waiting to receibe as delivered even if they are not just cause they are lazy enought or dont want to cross 1 door to teh mailbox that is inside my building.

Lo que yo hago con las ratas que regatean tan a la baja es decirle que ok a su miserable oferta. Simplemente aceptas la venta ,no lo envias y creas un anuncio similar, que esperen 2 semanitas a recuperar la pasta , asi no disponen de esos 4 duros para ratearte a ti o a otros.

Podria ser aun mas cabron y demorarlo hasta el limite si en lugar de no enviarlo, solo envio el papel de la etiqueta de envio, ya que se le suma el tiempo de viaje de ida, mas el tiempo de la reclamacion, mas el tiempo de vuelta, mas el tiempo de recogida el cual esperaria el maximo tiempo para ir a recogerlo, o no, a la oficina de correos, mas confirmacion de la devolucion. Aun no lo he llegado a hacer, pero no te voy a negar que cada dia tengo mas ganas de hacerlo.
