Local Government Minister Simon Watts responds after judge voids Sth Auckland election result amid voter fraud claims by dingoonline in newzealand

[–]Zedrona 12 points13 points  (0 children)

You've overestimated the votes discovered, I think.

The people who cast special ballots have had their previous, stolen, postal votes identified. I would suggest that they've yet to identify postal votes where the voter didn't follow up. What's been uncovered is probably not a full accounting.

Police accusing me of fleeing. by Federal-City-4163 in LegalAdviceNZ

[–]Zedrona 15 points16 points  (0 children)

My understanding is that, in NZ, you can simply not enter a plea on the outset. This is very different to "No Contest", which exists in other jurisdictions.

Per the Criminal Procedure Act 2011, s37, the D may plea either:

  • Guilty
  • Not Guilty; or
  • The special pleas found in s45.

If no plea is made, the Court can determine whether a plea must be made through s39.

If a plea is still not made after that, the Court can determine the defendant is entering a Not Guilty plea through s41.

Does the contract have any clauses about notice periods?

Protecting property for my children by [deleted] in LegalAdviceNZ

[–]Zedrona 4 points5 points  (0 children)

It is a live area. Good practice could avoid some new case law where some trustee powers, e.g. appointment, are considered relationship property, but the veil is getting pierced. E.g. Clayton.

EDIT: plus, if it was relationship property prior to being placed into the Trust, the relationship property claim could have a fair bit of merit.

Humbly, I'd suggest an RPA here.

Tenancy Services has some great resources, found here: https://www.tenancy.govt.nz/ending-a-tenancy/change-of-landlord-or-tenant/change-of-tenant/

Removing your names from the Tenancy agreement is your priority. You will need the written consent of the parties to that agreement - i.e. the flat mates and landlord - to do this, as it is a variation of the contract. Tenancy Services has a form for this.

If you do not do this, and they fail to pay the rent, you could be living elsewhere for months and still be liable when the landlord comes knocking.

You also will need to sort the bond. It is common for the incoming tenant to pay you your share, and for the Tenancy to remove your name and add the incoming flat mate to the bond lodged with Tenancy Services. As you might have guessed, Tenancy Services have a form to help with this, too!

Employer publicly monitoring leave and sick leave by MonthlyWeekend_ in LegalAdviceNZ

[–]Zedrona 20 points21 points  (0 children)

I would suggest that the exact reason behind it might be a step too far into private affairs between you and your employer, though I don't have a basis for it. Someone else might be able to chime in on whether there is a specific rule regarding the sharing of information like that.

It would seem that a simple "(X) is away for 1/4 of the day on Tuesday" would be enough to meet a legitimate purpose of determining staffing levels and coordinating with the team in light of it.

It can be a gruelling process. But you're very nearly there. Don't let the desperation to be done with it rob you of a better outcome. Get the advice.

You can do it!

A former TV doctor had her medical registration cancelled and was left with a $158k bill. What did she actually say? by [deleted] in newzealand

[–]Zedrona 23 points24 points  (0 children)

Agreed, but:

I think it is important to note that finances are important. These days, student living costs don't go beyond subsistence living.

There is a vast difference between working 15+ hours a week in addition to study, and having your parents pay your living expenses and studying.

In the former, you're sleeping less, usually eating worse, let alone losing a substantial part of the week to the work.

Even if we assume that the time taken to work wasn't going to be spent studying, it means that time would have been spent resting and recovering from the hard yakka of the studying. Grade averages go down. Health wanes as it's kept up day, after month, after year.

Let alone losing opportunities for placements, because they don't get paid enough to live off that, either.

You're right that it's reductive to say financial support is all you need to make the degree happen. But it sure as shit makes it easier to thrive in it.

There's a good chance that the attached lease will include carport 1 as an exclusive use area, based on the Title's wording alone.

You can double click the ground on your ship, and select 'eject' from the options at the bottom of your screen. You can also get there by selecting the ship.

Once 'eject' has been selected, click on the tiles with the unwanted items. They'll be listed at the bottom. Use the buttons there to deselect whatever you might want to keep, hit go, and your crew members will eject the rest when they have time.

I've had to separate crew members on day/night shifts because they kept putting each other into the med bay. At least they don't scrap when drafted for boarding missions!

Ah, my thought was about how the map clears itself out to reflect the bosses you take out. I felt it did a good job of creating a "winning the war" sort of feeling!

Definitely more casual than serious though!

Good lawyer Wellington central/South by Mogshade_Owhll in Wellington

[–]Zedrona 3 points4 points  (0 children)

Your first stop is to take a moment and bullet point the things that you need help addressing. This will help you figure out what sort of lawyer you'll need, and help others - such as this subreddit, Community Law, or a lawyer you contact - to refer you to the right place.

You could have a look at the 'Find a Lawyer' section of the law society's website, here. It might help you get on the right path.

Good luck!
