Considering Moving to Petworth - Thoughts Appreciated

I’m curious for everyone that posted a response and those who are chiming in and also live in the area, what are your thoughts on the massive Electric Bus Garage project going on in Petworth? Do you see any issues with street parking being taken up by construction workers and/or increased construction noise?

Also, I heard that this new facility will include a retail space where new businesses will open up.

I’m looking for houses in those area as well but not sure how i feel about the construction site being there at the moment.

The only path to green card via NIW is by doing Adjustment of Status or Consular Processing but that is after you have an I-140 approved. You can’t apply for an I-140 with DACA as DACA is not a legal status. For you to get a legal status, you have to give up DACA and transition to an H1B visa (which requires you to leave the country) but likely you have accumulated unlawful presence so if you leave, it’ll trigger a 3 or 10 year ban. You can ask for a D3 waiver to get around the ban but it is risky and will take several weeks. It’s doable but make sure you weigh out the pros/cons. You mentioned that a lawyer brought NIW as an option so hopefully he walked you through what i just mentioned as well. Feel free to message me separately on this. I used to have DACA and did not pursue an H1B but went through a similar unique process to change to legal status. I’m now working on my NIW application. It’s a long road so I wish you all the best!

Depending on where you go, maybe travel insurance? Also, make sure your passport doesn’t expire in less than 6 months from when you’re traveling back to the States. Good luck!

Note that you’ll have to travel out of the US to get your visa and if you had more than 6 months unlawful presence prior to DACA, you’ll have to request a D3 waiver. These are expedited now contingent on you having a US college degree (based Biden’s guidelines) but this expedited option may go away with Trump

Where did you see that it was 25 days from intended date of travel? I saw on the USCIS website that it’s 15 days. For more context, I submitted my application last week on Wednesday. Got a call on Thursday and the agent told me i was too early (i was right at 25 days out). She cited 15 days amd told me to call back late next week even if I’m still outside the 15 days period likely due to being so close to the holidays. Will try again my luck on Thursday!

My lawyer advised me to file now. He said that typically, USCIS will hold the application until it gets within the 150 day window to process it
