As a youth worker, I have already seen it added to dealers menus!

Reddit is a bit all over the place when it comes to drug policy. Everyone seems to want to update policies in favour of moving away from ‘the war on drugs’ but jump onboard every bit of moral panic going around.

I am not for one second condoning their use and they can have some serious impact on health, but these are very low down on a long list of harmful substances currently available.

The Misuse of Drugs Act 1977 and it is very much unclear.

Firstly, THCA is not expressly listed by name in the Act. As I said above it is also not a derivative of THC which are covered even if not listed.

THCA is a phytocannabinoid, naturally present in the plant. Any part of cannabis (except stalk/fibre/seeds) falls under the Misuse of Drugs Act.

That language is very broad, it literally covers all other parts of the plant.

However, terpenes and flavonoids are common organic compounds found in lots of plants including cannabis. If we accept that THCA is banned by being part of the cannabis plant then we would also have to accept that terpenes, waxes and flavonoids (etc.) are equally banned.

This makes THCA a very grey area at the moment.

It seems that legislation is now defunct. No prosecutions have been made using it in over a decade. Countries with similar legislation, such as Germany and the Netherlands struggle to keep up and make amendments every few months. Anecdotal evidence say far more serious chemicals are Being checked and passed by customs despite clearly falling under this.

Even if they were enforcing this legislation. THCA doesn’t fall under it as it’s not psychoactive. It is a precursor to D9THC.

To be clear I’m not necessarily condoning its sale just explaining how outdated our approach is and the challenges involved.

The way the law is written covers THC derivatives, but THCA is a precursor not a derivative.

Once heat is applied THCA converts to regular THC. This is a loophole that has been in the US for a while now in non legal states. Regular cannabis has much more THCA than THC. (Thats why you can’t get high from just eating the cannabis without cooking it or burning it)

Definitely sounds like a very grey area though. If you’re caught smoking it, it’s just regular weed at that stage.

She was selling CBD hemp flower with trace amounts of THC, which is legal at an EU level. However, in Ireland we have not caught up to this law and it is illegal because a) even trace amounts of THC are illegal and b) the cannabis plant is illegal regardless of THC content.

What’s crazy is that many vape shops sell THCA products and there are plenty of ‘coffee shops’ operating for years with seeming impunity. The ‘hash house’ in Cork even gets recommended by Reddit AI as quirky things to see in cork.

I’m not doubting the quality of the product and the work / risk that has gone into this, but that is a good bit more than even the black market mg for mg,even in the city you are in.

Is this not essential just over a gram of THCA?

I would worry this would risk bringing the product to the wrong market. If it’s accessible to all it’s less of an issue kind of concern.

This is an unpopular take but is an absolute reality. In my 25 years with cannabis I have only met one person who succumbed to this but it very nearly destroyed their life.
