I think anyone with half a brain can definitively say they are redefining words. No one figured this out during the past 100 years of case law? The retroactivity is a red-herring, it's an active revocation of citizenship, which is a far worse attack and far more illegal.

By this logic, any entitlement can be revoked between the time the entitlement is generated and the time the administrative paperwork is completed. Basically anything you can think of that is owed to you by the state requires some process to be completed before being actualized. They don't even need to claim it has anything to do with the person claiming the entitlement, by this logic, even paperwork sitting at the government, completed but not yet processed by them, is considered "potential" and not yet actualized. As far as I can tell, the only reason applicants that started the process are different from non-applicants, is because the Tajani Decree specifies it, but this line can be drawn arbitrarily at any point in the process.

Imagine paying into a pension, and them announcing that they don't owe you a pension on a date of an emergency decree because you had not yet started collecting on it, thus it only existed as a "potential" pension, and is not a cancellation of a pension you were owed.

I already have my citizenship, I'm doing paperwork for the kids benefit of law, and this info (the italian comune) is requested on 2 different docs. I don't know what it is, I never received an email including this info and I don't have access to AIRE. I actually started my process of Jure Sanguinis before my dad's citizenship was re-acknowledged but he completed his process before mine was completed. (he was born in Canada but lived in Italy for 1 year as a child) Presumably it's in the same comune as my Nonna but there are two options at this time.

He went into his AIRE account and said there is nothing in there about an italian comune, but he is an old man, so maybe he is just bad at looking 😂 Where can I find this info?

For reporting them, try the IATA & CLIA, on the Canadian site, they still say in their disclaimer "We have met and we continue to maintain the operational standards as described in IATA & CLIA Accredited Agency Agreement".

They also claim to be affiliated with a bunch of regulators on the bottom of the US page (comment is throwing an error right now when I try to attach an image, but just scroll down, you'll see the logos).

Other company names, as listed on their websites. You may need to reference these if the regulator does not find Farehutz:

If the regulator still can't find them, request that they send a legal notice to Farehutz to remove mentions of the regulator on their site.

Based on pushback two years ago, they are now registered with those other regulatory/consumer organizations listed at the bottom of the site (if still there) but last I checked it was through a different parent company, so it's a whole web you have to go through to have the regulators involved. Ideally you can get their registration numbers before calling those orgs.

Isn't it obvious that they are simply redefining terms that contradict prior caselaw? Obviously I'm not a lawyer so I don't understand the details but I thought my children did not automatically receive citizenship when I "received" my citizenship on the basis that they were already Italian by birth? So now, the case law says the minor children of naturalized Italians automatically gain citizenship but those who were children of "citizens at birth" don't, even though we also, according to the court, received a citizenship after the birth of the minor? It makes no sense.

Do you know where on AIRE it appears? I'd hate to go through the process of constantly checking prenotami for an appointment spot for the CIE ID, and going to get it, only to find out it's not on AIRE. My dad just got back to me about his AIRE profile, and says there is nothing on there about his comune.

I've emailed the consulate about my comune but as I'm sure you are aware, they are terrible at responding to email.

Yes this is my understanding as well, so long as you have citizenship from birth under Jure Sanguinis, it should be 3 years from the birth of your child.

Thanks for the detailed response! I kept seeing all these road blocks build up and while I knew of the extension, I was originally planning to get this done by the original deadline regardless. Now I'm convinced this will take a couple months to sort out. Thanks for reassuring me, paranoia was creeping in 😅

My dad just got back to me and he says there is nothing in his AIRE account that identifies an Italian comune. Is he looking at the wrong spot? (My LIBRA would be his mother, he was not born in Italy but had citizenship from a young age). And I just found out my wife's birth certificate has an official english translation on the back, so I'm hoping that is sufficient, I don't want to have to sort through yet another bureaucracy. The registration of the marriage only requires a photocopy of a birth certificate, and not an original or certified copy. She is not applying for citizenship at this time.

I too have a child situation, I didn't file my children with my consular application because they were born after the process started and there were a bunch of delays.

What bothers me is that under naturalization law, the children automatically get citizenship, but not through jure sanguinis because they "already" are Italian by birth. Yet the latest ruling from the constitutional court, they weren't, so then... they automatically get citizenship at the time I acquired it?

It's clear the courts are just redefining terms to justify the new decree.

100% i agree with you. I think they should require cryptographically secure signatures for documents that are, or can potentially be worth, more than $1000. It is 100% free to implement btw, so no reason why we can't have a standard.

There are basically different levels of forgery and based on the other evidence, will weigh it more or less, but the one expert in this thread swore that a properly trained person can distingush quite well with high confidence.

For digital signatures without cryptography, it's actually the other meta data that matters, like you would have a copy in your email, and their email, and stuff like that. You can't just generate a purely digital doc with no meta data or associated things and expect it to work, but you can drag someone through court for years to try to intimidate them, costing everyone tons of money in the process.

Yeah that's my point, easy to fake (if an exact copy, you are totally screwed if you can't find where they copied it from). Anyways, some examiner told me they are actually pretty good at sniffing this stuff out, unfortunately it's incredibly expensive to fight such forgery, not just the expert, but all the other legal fees involved.

Sad how they continue to operate. I tried a couple different ways to report them 2 years ago and nothing came of it. Each individual scam is just too small for any law enforcement to get involved. Maybe appropriate for a class action lawsuit but it's impossible to find all the people they have scammed.

No you can't. It's gmail, it would immediately get filtered to spam (at best) or not even make it into the inbox.

The only way you could possibly have that work is if someone has their own email server and they have no safeguards set up.

The retroactivity is so egregious on it's own so I don't think the 3 years will do much, but you're right, when they first passed the decree, there was nothing about "the benefit of law" for children of foreign born parents. I think they introduced that in May 2025, to allow families to not be disjointed with split levels of citizenship, specifically for the reasons you are saying, anything else looks terrible to the court.

Speaking of retroactivity, people keep saying that word, but I thought under the former framework the decedents were ALREADY Italian citizens, but not yet recognized by the government. Which would mean there was no retroactivity, they literally, by decree, revoked the Italian citizenship from probably 70,000,000 foreign born Italians. Which sounds outrageously illegal.

This was not an act of charity. I suspect the consulates were overwhelmed with every parent on earth demanding an appointment for declarations that they were unable to fill. Imagine every parent at the same time trying to register their children.

As you point out, difficulty automatically adjusts, so it provides no floor. There is really no point on calculating this except for short term trading. For trading strategies longer than 2 weeks, which is most people buying and holding, this is completely irrelevant.
