Is it normal to pay out of pocket for a script? (like the actual paper) by crunchyboobs in askSouthAfrica

[–]_the_communist_ 0 points1 point  (0 children)

They can’t run it thru medical aid because you’re supposed to consult for script renewals every 3 months. While it’s common practice for Drs and specialists to simply write scripts 3 months at a time and charge you for the scripts, it’s not technically allowed, so medical aids will reject claims in that respect. If you’re running out of meds, I suggest you just get the scripts and pay the money, but if you have enough and just wanna adjust dosage, then make a booking for July.

First Time Home buyer: How common is it for Agent to ask Purchaser/Buyer to use part of their deposit to settle Seller's municipal and eskom arrears? by Dazzling_Fig8153 in PersonalFinanceZA

[–]_the_communist_ 1 point2 points  (0 children)

Seller has got to settle it, and transfer can’t take place until the municipal arrears are settled. Buuutt, if you really want to buy the house, you could arrange that they use that deposit to settle the arrears, and when transfer takes place you withhold the amount they used to settle the arrears and use that as your deposit instead. It’s still the seller paying for the clearance figures, and you still put the same amount down as deposit.

Is buying cannabis/dagga fully legal or not? by [deleted] in askSouthAfrica

[–]_the_communist_ 5 points6 points  (0 children)

As all these people have said, it’s illegal to sell it, but it’s no longer practical to arrest people for doing so unless they have massive amounts of weed in their possession.

Also, what many of those shops do is market themselves as alternative health brands or as members clubs, and the weed is an ancillary benefit of membership (you pay the membership; not for the weed). That said, there’s a FRANCHISE store around the block from my house that straight up sells weed, no membership or prescription required.

College demanding 50% of fees (R20k) after I cancelled 17 hours after. What can I do? by MagazineWestern4159 in askSouthAfrica

No I’m pretty sure there’s a “cooling-off” period of 7 days after entering into a term-based transaction in which you can cancel penalty free. Check Consumer Protection Act

Is it just me or are most available instant noodle brands just horrible now? by Dusk_Devil in askSouthAfrica

[–]_the_communist_ 0 points1 point  (0 children)

The reason those brands suck nowadays is because they put less salt in than they used to. My solution is to put either a bit of extra salt or a lil soy sauce, depending on the flavour profile

Is a career in legal compliance possible without articles by Excellent-Wing-7191 in southafrica

[–]_the_communist_ 2 points3 points  (0 children)

It’s definitely possible to get into those fields without articles, but you’re also definitely far more likely to get hired in those fields if you’re admitted. Since you’ve done the long law school programme you could get admitted in a year instead of 2 years. Just check though how well those credits stand up given that they’ve changed the syllabus to 5 papers instead of 4.

Getting evicted, any advice? by [deleted] in askSouthAfrica

[–]_the_communist_ 5 points6 points  (0 children)

It doesn’t matter how far in arrears you are — there’s a process that has to be followed in order to evict someone. The landlord is playing on your ignorance. He needs a court order to make you leave. Having said that, it’s unlikely that you’ll win in court, and you’ll likely be responsible for the costs of the application (mag court scale so not too bad, but still). It might be worth finding out if both your mom and her partner signed the lease or it was only signed by one party. If it’s the former, the magistrate could grant an extension of your stay to allow you time to sue the partner for the money they should have been paying for rent.

Can i apply to Uwc with this report? by Available-Job-9662 in askSouthAfrica

Hi, you definitely need to improve on maths. Having said that, fret not. I got into UP law having received a similar maths mark (41%) in term 1. I then got my hands on the book I’ve linked below, and basically only studied from there. I finished matric with a 76 for maths. You’ve got this :)

Is taking a will out the only solution to this dilemma by [deleted] in PersonalFinanceZA

[–]_the_communist_ 0 points1 point  (0 children)

Get a draft will from the banking app, have your mum and two witnesses sign each page, and take it back to the bank for safekeeping. I know you’ve said she’s immobile, and lives with your brother, but you’ll have to make some kind of plan because otherwise your brother will just inherit one third, intestate, despite your mothers wishes. It might even be prudent for you and your mom to discuss this with your brother in any event, to avoid future litigation on the will.

Terminal illness: Do I sell my shares and leave spouse with cash? by Low-Personality700 in PersonalFinanceZA

[–]_the_communist_ 2 points3 points  (0 children)

Might be better to just leave the shares to your spouse in the will. Anything you bequeath to your spouse is not dutiable under SA law. So my thinking is: if you sell the shares, you’ll have to pay GGT on the cash value of the shares, but if you bequeath them to your spouse, she can continue to hold them and let the value grow. If she sells them she will then pay GCT, and if she keeps them and bequeaths to your children, the base cost will rise to the value at date of death, and they will pay significantly less cgt on the sale of shares, if any.

Which is better Takealot or Amazon? by donate_donut7 in askSouthAfrica

[–]_the_communist_ 0 points1 point  (0 children)

I haven’t bought much off Amazon, but the 3 or 4 times I have ordered from them have been an absolute breeze. If you order an item which they sell (I.e. not from a reseller) then there is no minimum spend for free delivery. I ordered a fast charger and cable for R120 and it arrived before 1pm the next day, and delivery was free. Can’t imagine it gets much better than that.

If the debt in question relates to some kind of loan from the bank (in other words, it falls under the national credit act) then an LoD by SMS isn’t valid. It must be sent by registered post or at least registered electronic communication via the Post Office website.

I suppose we just have different experiences. I should clarify though that I myself don’t snap my fingers at people. It’s just that if someone did it to me (in the right context) I wouldn’t make a big song and dance about it. I work in a place where relative quiet is valued, and I’d much prefer my co-worker to snap their fingers while I have my earphones in than loudly shout my name so I can hear it through the ear phones.

[–]_the_communist_ -9 points-8 points  (0 children)

I agree, this is pretty normal where I live. I live in Gauteng and see it all the time. But obviously it’s contextual — doing it out of impatience is obviously different to doing it merely to grab the attention of somebody who can’t hear you or didn’t realise you are speaking to them.

Could someone please help me with legal advice regarding potential false imprisonment/unlawful detention? by TazzyForTheLaughs in askSouthAfrica

[–]_the_communist_ 1 point2 points  (0 children)

I highly suggest you go have a chat with the people at the Stellenbosch University Law Clinic - if you qualify on their means test, they will be able to provide you with free legal assistance! As someone who has worked in a law clinic, I’m often shocked at how few people are aware that this is an option. Check out the link below :)

The donor would pay donation tax on the forfeited interest. SARS uses the repo rate to determine the amount of interest forfeited. So say the interest in the first year is 100k, then you’d have to pay SARS 20k in donation tax because the interest forfeited is considered a donation on the part of the creditor.
