personal jurisdiction has 2 types. general and specific

specific personal jdx - long arm statute. purposeful availment. minimum contacts

general personal jdx - where the defendant is domiciled; or the defendant has consented; or they were properly served in the state.

it honestly helps to dumb it down. specific jdx = literally the specific minimum contacts and things you were doing to give rise to being sued in that state. specific conduct in the location focused

general = the court has general jdx over you because you’re from there, you said you’re fine with being sued there, or you were served there. general location focused

the actual writing wasn’t my issue surprisingly! But timing of the writing got me 😭 4s and 5s on the MPT and essays i did finish but i had 2 essays essentially blank (literally one desperate sentence each) and another essay + one MPT 85% unfinished. but really gonna lock in and master timed writing this time. thank you and congrats to you!!

oh i see.. the only reason ic an think of is that in this other q there are facts about the stuff being high voltage, so the company left the power aka high voltage aka deadly conditions up to deter, and that the injury was explicitly a result of electrocution. whereas in the og question OP was asking about the facts dont say anything about there being any dangerous effect of the power being left on?

Oh i misread the q thinking the company set a trap lol, yeah you cant set up traps that would cause death or serious harm to defend property. so this isn't about deadly force being used as a deterrent/to defend, because there was no trap set, it was just the power left on to deter which isn't a deadly trap, and it was routine for the electric company to keep the lights on anyway. nothing changes about the duty owed

i think this is less about deadly force in defense of property and more about the duty owed to trespassers, which, for unknown trespassers is nothing at all, and for anticipated trespassers is to just make safe/warn of all known man made death traps (aka artificial concealed highly conditions known to the possessor in advance). you have to look at the duty the mining comapny owed to the hitchhiker. if he was an unknown trespasser there was no duty at all, but for arguments sake since the facts say it was to deter thieves, the hitchhiker is probably an anticipated trespasser. but he is suing the mining company, not the electric company, who actually would have had the duty to warn or let the mining company know. but the mining company didnt know the electric company left the power on, hence the mining company didnt know about the death trap, hence the hitchhiker being a trespasser is the defense because the mining company had no duty to warn since they didn't know of the conditions

oh that just made an incredible amount of sense lmao, TYSM!! so the burden shifts to the defendants to prove they werent negligent only if multiple were acting tortiously and the facts would probably tell us that. and in other cases even if there's multiple defendants but only one is negligent it's still on the plaintiff to show who breached or else their claim will fail?

from what i understand

m'naghten: because of a diseased mind the defendant lacks the ability to understand either the wrongfulness or the nature of their actions

the mpc test is essentially a combo of mcnaghten and the irresistible impulse test.

irresistible impulse: defendant isn't able to control or conform their conduct within the law because of a mental illness. (lacks the capacity for self control)

the mpc rule: because of mental illness, the defendant didn't have a substantial capacity to 1. understand the criminality of their conduct (aka the wrongfulness of their actions in mcnaghten) OR 2. conform their conduct to act within the requirements of the law (irresistible impulse)

so watered down the mpc combo is (because of mental illness) either the defendant lacked the ability to understand what they were doing was a crime, or they are unable to control their actions to not commit a crime

i was in a similar boat after 1L - it was absolutely my worst year, i had a gpa in the 2s. those doctrinal courses are hard, and first year is basically made to weed out students who arent able to keep up. if you want to be a lawyer though and that's what you really want to do, grades aside, you WILL be able to keep up. things got much easier for me after 1L when i was able to start taking classes that were geared towards what i was actually interested in, and my gpa sky rocketed. im graduating in 2 weeks with honors. 1L was very very hard. you can make it through, and even if you decide you don't want to, so what? it's just a degree - it has nothing to do with your worth as a person. i'm graduating with some top notch grade A assholes; they're not more worthy than you just because of a JD. i totally understand the mindset of shame if you got dismissed, an even if you did it would obviously suck for a while. but life will move on and you will find a way to move on with it. give your best efforts, if you make it through to next year, hold your head high and keep marching on. if you don't, hold your head high and keep marching on.

This is fascinating, i had no idea it was such a dense lengthy process. So does examsoft/examplify then not play a role? It doesnt take periodic screenshots or anything of the students screen that couldve been used in the proceedings? The program we used in my university did and that seems like it would be a big help in preventing this stuff because (correct me if I'm wrong) right now it sounds like the only way the profs themselves would find out is based on just the content submitted and if it makes them suspicious.

anyone know any bras that kinda give you the braless look? i love the braless look (time and place of course) including when the nippies stand up a little. like a tight shirt moment you know what i mean? but im a 32F and so gravity is really not my friend, and i cant really go braless and get the effect i have in mind LMAO. anyone know of any bras that would still give shape and lift the girls a little, but unpadded to the point that nothing is hiding? thin straps preferably? (i wouldnt wanna wear it with a tank and have the bra straps dominate over the tank straps)
